    Default making a representation, do i have a chance?

    Hello forum, hope you are all well.
    I would be super grateful for any suggestions.
    I have had a good look in the forums, but have not have had much luck in finding help in making a formal representation, which I would like to do.
    The Southwark council have replied and rejected my first letter on the grounds- " for parking with one or more wheels on any part of an urban road other than a carriageway (footway parking) - vehicles should only be parked with all the wheels on the road"
    I have attached the photo the office took of my car parked off the road.

    The reason for parking there was, I needed to load a heavy product onto my roofracks and had to be close to the exit. Also I was away from the car for less than 3 minutes, which i feel is unfair.
    Do i have reason to get this pcnicon cancelled?????
    Any advice would be hugely appreciated.

    That doesn't look like a footway to me, more a bay of some kind.

    Hello
    yes loading a large awkward shaped product into roofracks. warning hazards flashing, and only gone for 2 minutes. was the quickest ticket ever...officer gone without a trace, must have run off or hidden in order to get the ticket and photo processed before my return.

    No. This is just plain thoughtless and you deserve the ticket. Two pedestrians are walking into the cariageway to go around your car. What about someone in a wheelchair?

    I for one can never, ever endorse a footpath being obstructed at all, never mind to this extent. It is totally wrong that pedestrians should walk in the road whilst cars park on the footpath.

    Be off with your head - a parking ticketicon? You should be locked up for life. Those poor pedestrians having to walk a foot off the pavement in a completely empty road. Get a sense of perspective man.

    Joke all you like. I am disabled and I for one do not think I should have to struggle into the road to go around an illegally parked car obstructing the footpath. Maybe you feel otherwise. No need to 'off with his head'. But zero sympathy for getting a ticket for parking right across the footpath.

    Forgive me for saying but the gentleman in question parked for an extremely short period of time in order to carry out a difficult task. I appreciate that there may well be many obstructions that can make life difficult for disabled people; however, this is not the fault of the person this thread is about. I feel that the traffic flow would be far better in this country if people were reasonable and realistic about parking rather than ideological. I think to comment that big_bonsai is plain thoughtless is quite harsh. If only we were all blessed with perfect judgement............

    Footpaths are not meant for cars therefore they are not contructed to carry vehicles. Hopefully the fine will go towards the cost the Councils incur every year repairing footways and grass verges damaged by car drivers.

    It's not a footpath - there's a kerb behind the car which isn't even dropped (as far as I can see).

    Can we see some better photos, any signage, and scans of the pcnicon both front and back?

    It looks like an odd setup, with some sort of parking bay, but some more images would help.

    Refusing to help because you deem a person 'deserves it', without knowing all the facts isn't what this forum is about.

    Are you suggesting he damaged the footpath then, besides I drive over a footpath every night to enter my property as do millions of other people. Therefore, if footpaths are not designed for vehicles - is that not the council's fault?

    What is this forum about then? The person comitting the driving offence is always right? Not why I joined!

    OK. Looking at the picture it is clear that the footpath continues across the entrance to the car parking on the right. The entire frontage of the parking area seems to have a lowered kerb. The footpath is between the yellow line and the boundary of the property on the right, which is where the holes are for parking bollards/fence stakes etc.

    The car is clearly parked right across the footpath and although some of you seem to belittle the fact, it is highly irresponsible.

    This is a public forum and people are entitled to say what they think. Sometimes we will disagree. I have principles and standards whilst others clearly haven't.

    Just in case any of you need reminding, cars go on the road and pedestrians go on the footpaths. Obviously some of you don't understand that principle or simply choose to ignore it. When you ignore it and a traffic warden sees it, they give you the ticket, quite rightly.

    One thing I have noticed in this section of the forum is a common factor that everyone is only ever 'there for a couple of minutes'. And there is never another way of doing it.

    Could have had the item delivered, could have parked around the corner and carried it there with help. Could have used a trolley to move the item. Could have though about someone actually daring to use the footpath. God forbid.

    Sorry if I rattle a few cages with this, but as you will have gathered, I do not mince my words when it comes to thoughtless parking. I will never be condoning pensioners, kids, disabled people or anyone being forced to walk into the carriageway just because someone wants to collect a table or something, which will only take a minute (or 15)

    The fact that others are supporting this only endorses the society we live in in the UK. Me, me, me , me , me.

    looks like people could also choose to pass on the other side of the car and not go into the street. (not relevant to sort out if the pcnicon is valid on all three 'legs' as it needs to be to be upheld but worth pointing out.

    If penalties were given out for moral offenses a lot of councils would lose a lot of staff to places in jail.

    lets get on with the PCN itself .

    Its an offence to do so under the Highways act unless the footpath has been modified to carry a vehicle, even if it has the crosssover is for crossing the footway not parking on.

    In your opinion it may not be of help but knowing his position as far as the Law is concerned may be benificial to the OP or others in a similar situation. Posting just to comment on the validity of other peoples posts is in my opinion of even less help.
