I ahev another thread currently running in the barclaycard forum re a cca , but am just a bit unsure about Claiming PPI & contractual interest .
Was suggested to post an new thread here and see if you can help me please :0
I am unsure if being charged ppi at the mo , and because cant get cca cant find out ! Where would it show on my statement please i this was being added ?
Unsure if this is the right place to ask the next question, but will giveit a go ...
When i get to the stage of claiming back my unlawfull charges , have noticed a few claiming back contractual interest aswell , is this only claimed back if you have had ppi ?

Have you sent a Subject access request?
You will need your CCA to see if PPI was added to the card.
PPI would probably not appear as a separate item on any statement it would be included in the total figure due for the card in any month.
No you can claim back contractual interest on unfair bank charges as well as PPI. You might additionally get statutory interest added as well.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc
Please do not PM me for advice as it may be sometime before I can respond.
Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
hi thanks for the reply , not sent SAR just yet am waiting till get paid on the 15th to send that off .... They cant locate my cca i presume as it origionally was with morgan & stanley and they keep sending me bc terms & cond , so am presuming that they dont have one . Is there any where else i could check on statements to see if the PPI is added ??

If they have not produced a true copy of your cca then insist it is provided when you send the SAR put the onus on them to provide you with the information you are paying £10.00 for;-)
If they fail to provide the CCA then send a complaint to the Information Commissioners Office stating they are failing to comply with your SAR that you have sent the statutory fee but they will not provide the information. Beter to go down this route before any further action to the fos and/or court.
