    Default GE Money - no longer any outstanding monies???

    Hi,

    I've a few accounts with ge money - 600,700,1500,2500

    I sent off PPIicon letters and cca requests in Feb/Mar and this is the response I've had from them:

    My address & acc details

    Dear...

    Thank you for your letter requesting a copy of your agreement under Section 78 Consumer Credit Act 1974.

    As there are no longer any monies outstanding to GE Money, there is no obligation for us to supply this information, as specified in 78. I am therefore returning your enclosed cheque to you.

    Any such requests should be sent to CL Finance. Their contact details are:

    ....

    I trust this clarifies the situation and I am sorry that I could not be of assistance on this occassion.

    I am bemused to say the least. I have a list of questions I'd love some help with.

    does this mean I no longer owe the debt to ge money?
    will ge money be able to chase me for this money - in light of this letter?
    what do i do with regards CL finance?
    can cl finance enforce a debt the creditor has claimed i no longer owe?
    what do i do re: ppi claim?
    can i put in a SARicon request and claim back charges?

    Is this all a smokescreen?

    Hi, meerkatsmimm.

    The 0 balance means GE Money have sold your account to CL Finance.

    CCA CL Finance.

    Regarding the PPIicon, I'll see if I can get someone to help, I would think you can still claim it back.
    Send a SARicon to GE, then you can re-claim any charges.

    Thanks for that.

    can they sell the debt after i've asked for them to provide me with CCA?

    If I send a CCA request to CL will they refer me back to GE? (Moorcroft did this with my husband when he requested an Eggicon CCA from them).

    Can I rest easy that this debt is probably gone - or do I need to pursue CCA's for them and force the new owner's to produce a CCA, which they probably can't as all accounts are more than 5 yrs old.

    Hi,

    I take it you've had nothing from CL, GE should not sell the debt on whilst looking at your CCA request.

    I think CL will still chase you for the cash, they should provide you with the CCA.

    It's always recommended to send the SARicon to the Origional Creditor and the CCA to the DCAicon.

    It's always worth going for the charges,if they happen to come up with the CCA, what sort of amounts are you talking about.

    Thanks for that Scott,

    To be honest I am not sure about charges other than what would be owed through the PPIicon, which would go some way to making a decent settlement should I need to go Full and finalicon.

    However, what I find very strange is that other than offering CL Finances's address, they make no reference in the letter to having sold on my debt. On top of this, the letter is hand signed (blue ink) and clearly states that I owe no money to GE Money and is dated. Surely this is a declaration (whether they intended it to be or not) that I no longer owe them any money?

    Surely this is the letter every one wants to get? They are telling me I owe them nothing, and they are the original creditor and arent making any reference to the fact that the debt has been sold on, other than than to say I can contact CL Finance for a CCA. Would a court not agree here?

Where there has been any event in my account history over this period which has required manual intervention by any person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my account formerly held with ORIGINAL CREDITOR. - delete or add this depending on whether you are sending this to the original creditor/or a debt collectionicon agency



    3. True copies of any notice of assignment and default notices or enforcement notice that you/or name of the original creditor sent me, with a copy of any proof of postage that you hold.

    7. A genuine copy of any notice of fair use of my data as required by the Data Protection Act 1998



    8. A list of third party agencies to whom you have disclosed my personal dataicon and a summary of the nature of the information you have disclosed.



    9. Copies of statements for the entire duration of the credit agreement/s.

    Thanks for that 42man,

    Can i not try to call their bluff so to speak by sending a letter back stating that as I owe them no money, will they now mark my credit history with equifax, etc, as being settled/satisifed?

    Surely CL Finance will be obliged to provide me with a valid CCA if they have indeed bought over the debt? So should I CCA them or SARicon/CPR? If they cannot provide the CCA will they have to refer this back to GE Money?

    Below is the actual letter sent by GE to me, can you tell me if this is enough to amount to them admiting (intentionally or not) that I no longer owe them anything?

    I wonder if you could use this letter against them, they are admiting there is no debt to them so if the agreement is between you and them then the debt is satisfied, you did not enter an agreement with clueless

    Thats what im thinking.....

    Plus they say only genuine signatures, not scanned photocopies would count in these instances - this is a blue ink signatureicon and is a genuine one!

    Anybody know for sure if this is them messing up?

    Hi,

    CL Finance have written to me 3 times. First letter 15/03/09 stating they've formally become the owner of the £700 debt. 2nd one, 16/03/09 telling me that I owe them £700, and third also dated 16/03/09 I think, thanking me for offering them £1 and them accepting it, asking for 1st payment to be sent by 8/04/09. I've never been in contact with them as GE only informed me they no lnoger owned the debt on 26/03/2009.

    Now I've been away from home and the letters have been sent to my previous address, so have taken a bit longer to come through the redirection, even though GE wrote to my current one so I'd have assumed they'd have used my current address when they passed the file on. I'm only just getting to reading all my mail and seeing this deadline which I'm not going to achieve even if I wanted to.

    Here's the thing - my credit file hasn't shown this particular GE file for 2 months, and still doesn't. It has however this week turned up as CL Finance file on my account with 3 late payments. How can CL register 3 late payments when they only aparently acquired the debt on 27th February 2009, and that they only request the first payment for 8/04/2009?! I sent CCA req. £1 cheque the same day I sent token payment £1. The £1 CCA cheque was returned to me but GE cashed the £1 cheque I wrote to them for this £700 account, after the date they apparently sold the debt. The cheque was sent 12/03/09 and they sold the debt on 27/02/09. Can they do this?

    This is what I propose doing-

    *send GE reminder for PPIicon
    *send SARicon to GE for all accounts - I'm sure there's a few hundred quid at least in charges on all 4 accounts over the years - accounts taken out in 2002,2003 & 2004.
    *send CL CCA request as I don't recognise debt with them for all 4
    *additional letter to CL Re: £700 debt asking them to refrain from adding any information to my credit file, and to remove the existing information from my credit file until they can produce the agreement that I have with them. Also, stating that as I've never been in contact with CL finance, nor have I sent any money to them, so how they can accept an offer of £1 from me when I haven't made them any such offer is beyond me.

    What do you suggest?

    right,

    i'm formatting some letters for CL.

    should i format a 'all-for-one' letter referencing all 4 accounts or send them individual lettersfor each account?

    The £700 debt is the one cl have written to me about - although they have obviously spewed out 2 months worth of letters in one go so that they can hurry up the ccj process and probably take me to court soon, given that I've apparently missed 3 payments already!

    I'm visiting family for easter but can only assume the same letters await me regarding the other accounts.

    Do I ask for CCA's from CLF for these accounts or do I write to them and tell them that GE Money shouldn't have sold on the debt as it is in dispute?

    Do I not ask for CCA from CLF, and go straight for a SARicon? Also claiming that I do not recognise any debt with them?

    Any advice and letter templates greatly appreciated!

    Here is the letter I have drafted to send to GE Money in response to them stating I 'owe no monies to GE Money'.

    Apologies if this is crappy, wrongly worded etc, I would appreciate some guidance as how best to put this to them as I want to make it clear that my understanding of their letters (x4 and all personally signed in blue ink, so true original copies ) is that they dont hold me liable for any money owed on the accounts.

    Have a look, im swinging from the hip here a bit!



    13th April 2009

    Referencing the following GE Money Accounts:
    B&Q – xxxxxxxxxxxxxxxxxxxx
    Dorothy Perkins – xxxxxxxxxxxxxxxxxxxx
    Debehams – xxxxxxxxxxxxxxxxxxxx
    Evans - xxxxxxxxxxxxxxxxxx

    Dear Sir/Madam

    I write in response to your letters dated 26th March 2009 where you have informed me that I no longer owe GE Money any monies for the above 4 accounts listed in this letter.

    I note you also returned my CCA Request with a denial for this information stating that reason above for failure to provide a copy of any credit agreements under section 78 Consumer Credit Act 1974 and returned the enclosed cheques for fees payable uncashed.

    As GE Money is the Original Creditor for all three accounts, you are legally responsible in supplying me with this information at any stage that I request it from you.

    Further to this you go on to supply me with a name and address for CL Finance, whom I acknowledge no debt with, nor have you stated why I should contact this same company in the future.

    I would also like an explanation as to why you have cashed my £1 token payment cheques (x3) for March 2009 yet you state very clearly in your letter that I no longer owe GE Money ‘any monies’.

    Given that you have supplied me with a true and genuine letter, personally signed in blue ink (and therefore not a template copy) stating ‘as there are no longer any monies outstanding to GE Money’, I would now request that you remove any negative markers (or Default Notices/ Default Markers) from my credit reference history held with any credit reference agency and mark my accounts as being ‘satisfied in full’.

    As I no longer owe GE Money ‘any monies’ for the above 4 accounts listed, I would now request that you cease processing my information with any 3rd parties (aside from marking my accounts as satisfied in full with all relevant credit reference agencies), including but not limited to Debt Collections Agencies or other agencies acting or working on your behalf.

    Given that I hold these 4 letters signed personally by Stacey McDermott, GE Money Credit Data Management, stating that ‘there are no longer any monies outstanding to GE Money’ for the above 4 accounts, it is clear to me that neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever now or in the future and that I am released from any liability for the above accounts.
