My wife has a loan with the Halifax and has started the re-claim process. They have admitted liability that they mis-sold her the PPI insurance and have made her an offer around £1,220 pounds including interest at 8%.
They have told her that they will use the refund to reduce her loan balance and that in order to do this they will have to arrange a loan for her which they will turn down and then the refund will go ahead.
Now they want her bank details for this odd loan arrangement for the payments to come out of but she is suspicious about and is not happy to do this.
Can anyone tell me if this is normal procedure or are they trying it on by giving her a loan to refund her PPI. In other words you borrow to pay for someone else's theft of your money.
Now they are asking for her to repay her overdraft in full which has only come about since making the re-claim. Can they do this?

Good so far but have you worked out what PPI premiums you have paid on this loan so far? Also they are offering interest at 8% was this the contractual interest applied to the loan?
They have told her that they will use the refund to reduce her loan balance and that in order to do this they will have to arrange a loan for her which they will turn down and then the refund will go ahead. The Loan as I understand it would have to be re written to exclude the PPI however in my case this did not happen until the fos became involved.
I would suggest cancelling the PPI on the loan (as long as you have an appropriate alternative cover from and on line insurer or from the employer, not good to leave yourself uncovered but PPI is cheaper online than through the loan company.

Just edit the SAR to suit your own situation and send it off to halifax. This will mean they have to provide you within 40 days a true copy of the credit agreement with the appropriate terms and conditions attached to the loan including all of the prescribed terms, copies of the appropriate statements on the account, any other data such as letters, emails, files as pertaining to you as a data subject. The fee is £10.00 as required by the Data Protection Act 1998 but my it makes them do some work for the tenner.
Now they are asking for her to repay her overdraft in full which has only come about since making the re-claim. Can they do this? Retaliation of any action by a customer is not allowed by law (I will have to hunt for the law) but please send the details to the Office of Fair Trading and the Financial Services Authority and they will be very pleased to hear what Halifax are doing.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
