Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Please could someone tell me the procedure to start a claim against WELCOME fiance for missold PPI.
The original HP agreement was taken out in 2007 through Ucan/Car Craft (Do not recommend them!!!)
I was told at the time that if I did not take the PPI/Mechanical Breakdown I would not be allowed the Loan/Car!!
And it would be to my advantage, well I am now unemployed, and it IS NOT to my advantage, as I have been doing contract work!!!
My agreement does not make much sense to me at all..

Quote:
When determining whether a policy is suitable, a seller – whether a lender or an agent for the insurer – must obviously take into consideration any information the prospective policyholder volunteers. However, we do not consider the seller’s duty is limited simply to recording what the borrower discloses. It is only by asking questions that the seller can properly determine suitability. These questions cannot cover every aspect of a borrower’s personal position and should not be expected to do so. To paraphrase the ABI Statement, only those matters deemed to be relevant by the insurer should be the subject of questions.

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
You have to be in for the long haul with Welcome they do not give in easily but there are plenty of people inc me that revel in making Welcomes life a real pain in the ass - i'll do all i can to help
I am a layperson and have no legal training but I do have an iota of common sense (sometimes)

Thank you to everyone.
When I took out the loan I was in a Fulltime job, (August 07) then from October 07 long term contract work, as I was made redundant in Sept 07.
I was lucky that I was able to work and cover the loan repayments.
Now unfortunately I cant..as unemployed !! have defaulted on 2 payments...
Right ok then - I thought if you were in contract work that might have given you an easy out but unfortunatley we're gonna be in for a fight here.
The first thing you need to do is complain to Welcome Compliance in writing about how you were sold the PPI tehy will probably yank your chain and stretch you complaint out for ages before giving you a final response that you are wrong.
They have 8 weeks from the time of receiving your complaint to issue a Full and final response and after the 8 weeks if they haven't you can then chose to complain to the fos or you can bypass that and go straight to small claims.
Are the insurances still on your loan - you need to get these removed as well so you should contact Direct Group who administer the policies and ask them to be removed as you no longer qualify to be able to use them.
Welcome should also restructure your whole agreement for this not just take it off the back end - this is wrong but is what they will try to do.

Call DG - if you google direct group and ring customer service number.
It's not worth your arguement or phone bill telling them the polciy was mis-sold they just refer you straight back to Welcome - just ask them to cancel it immediately as you can no longer qualify to use them and then you will have to get on to Welcome about securing a recfund of all PPI made - I'm 99% sure they will say no so you have to be prepared to go to fos or court and also DO NOT let Welcome just take it off the back end of your loan - insist they restructure your payments - but be careful they don't get you to sign paperwork extending the loan or anything like this - Welcome are extremely sneeky!!

I did mention to the guy that I read a lot of negative reports about them DG/Welcome, he said they were nothing to do with Welcome!!
A load of rubbish!!
Will act upon every ones great advice here..and WILL NOT give up.. have plenty of time to fight with them as I am unemployed right now, and with the back up on the site..cant go wrong
