    Default CAP1 - PPI - Online Application ?

    First off, sorry if this has been asked a number of times - honestly I have tried searching before posting..

    Situation :

    Currently got a thread going http://www.consumeractiongroup.co.uk...ight-cap1.html


    I received my FULL SARicon details today and they've stated " You requested Payment Protection Insurance over the internet on xx April 2003 " I have enclosed the PPIicon terms & cons applicable at the time... ( I notice on the footnote of the terms it shows - PPI/TC/0503 - ie may 2003 not april, does this make a difference )

    Question : Is there anyway to determine if " I " chose to add the PPI or if " they " added it in after ? or is there anyway I can claim mis-sold ?

    Situation :

    I received my FULL Subject access requesticon details today and they've stated " You requested Payment Protection Insurance over the internet on xx April 2003 " I have enclosed the PPI terms & cons applicable at the time... ( I notice on the footnote of the terms it shows - PPI/TC/0503 - ie may 2003 not april, does this make a difference )

    Question : Is there anyway to determine if " I " chose to add the PPI or if " they " added it in after ? or is there anyway I can claim mis-sold ?

    PPI is a long and multi faceted subject so many different issues such as PPI on cards, loans, mortgages, cars etc and each one dealing with a multitude of issues such as lenders, brokers, insurance companies etc. It is not an easy subject but the best way to approach it is firstly get the data.

    Can I reclaim on any PPI policy?
    Your claim for compensation is dependent on when you took the insurance. PPI sales only came under the jurisdiction of the FSA on 14 January 2005. Any sales made before then are not covered by the latest rules.
    However, it may still be worth complaining to your lender if you feel you have been mis-sold. If you bought before January 2005 it is likely that they will have been covered by a previous regime of rules. This means that the Financial Ombudsman Service will be able to consider these complaints. If you took PPI after January 2005, your claim is subject to the latest rules.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Thank you for your reply and links. I've seen the contents of the links already and it totaly confused me ( hahah I read it all as part of my previous seach before posting ), I will have another look though.

    Don't know if this helps my case or not but I received a letter from CAP1 today - any thoughts ?

    Due to a system error, we did not notify you that you are no longer covered by Capital Oneicon Payment Protection Insurance. Your policy expired because you did not bring your account up to date. It certainly looks like your PPIicon was a limited cover for 5 years as in a lot of cases. I would certainly contest the PPI especially as they failed to notify you that your cover had expired. I also note that they say it was due to their system error but then go on to say it expired because you did not bring your account up to date.

    How can you bring your account up to date if they failed to notify you that the PPI had expired due to their system error

    could you possibly post up the full letter taking out the personal bits? ie account numbers, names and addresses etc.

    You will need to read through the links posted earlier as the reasons for mis-selling are quoted in there. If you fall under any of those categories you can claim. Some of the categories are:

    Unemployed
    Full time student
    Self employed
    Pre existing medical conditions
    Retired
    you will need to read and if you fall into any of the categories mentioned they you can claim.
