Just to let you know what I have done we recently redeemed a mortage with A&L for a second property we had and had sold, so I thought I would just try and see how far this would go.
Sent off the DSAR and got statements back within about a week or so and working on what the had sent me I could see charges on there for approx £700 and also the had charged a redemtion fee of £295 even though we had had the mortgae with them for about 15 years!!
Sent off the prelim letter - got usual sod off response
Sent off lba - got same response.
So on Saturday I put through my claim on Money Claim for £1010.00 plus about £120 ish in the 8% interest.
The money claim was issued on Monday the 24th and today they have acknowledged it.
Not sure how far this will go being a mortgage but Im going for it never the less.
Recieved a notice from Northampton court today showing the acknowledgement of my moneyclaim by A&L with the box ticked that they intend to defend all of this claim. It is signed by a Jackie McGuire (Solicitor) for A&L Group Legal Services has anyone had the same thing happen to them?
I have been very remiss and not done my claim against A&L yet, but this sounds like the norm. If you haven't done so just put the word redemption in the search facility and you will find all the threads where this is mentioned.
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.

Well latest is recieved a letter from Alliance and Leicester this morning stating
We have recieved from Northampton county court this morning the Claim that you have issued. We are unable to ascertain how you have arrived at the figure of £1131.38. Can you please provide a detailed breakdown of you calculation within 7 days from the date of this letter.
In order to assist you we would advise that you are only entitled to make any claim for a period of 6 years, any charges therefore incurred before the 23rd July 2000 will be statute barred. We calculate that your charges during the 6 year period come to a total of £500.00 and the interest on those charges as 8% per annum amounts to £96.12 up to the 26th August, being the last date upon which we can file a Defence.
We look forward to hearing from you within the next 7 days failing which we will be considering our position further including defending the action. In the meantime we enclose the acknowledgement of Service filed with Northampton Court.
Despite them having the breakdown of the charges twice once with the prelim and once with the lba I have sent them to them again today. The only was that I can see them coming to their figure is by adding up the Arears Fee but ommitting the Returned DD figure and the admin Charge (which was the redemption figure) The letter that I have sent them is below:
Thank you for your letter dated today reference the above case. As per in the two previous letters sent to Alliance & Leicester I have included a breakdown of the charges on the account which were ascertained from the copy statements in response to the DSAR request.
Thank you for the advice of the dates of entitlement but you will see from the breakdown that the first date claimed is the 3rd January 2001.
I have included 2 breakdowns for your perusal the first being the charges plus the 8% interest as at the date of the claim being made which was the 22nd July 2006. To keep in line with the letter you have sent where you have quoted the 8% interest up to the 26th August 2006 – being the last date a Defence can be filed by yourselves – I have therefore amended the interest calculator to that date.
Will be interesting to see what they now come back with
