    Default MBNA PPI - making a claim.... easier to rob a bank????

    My wife took out PPIicon when she applied for her virgin card, she has last month been made redundanticon, rang them and advised as soon as she was and that she wanted to make a claim on PPI. Was advised information would be put into the post to her. She followed that up with a letter also asking for the same just in case.


    This week she gets a letter telling her that her PPI complaint is being investigated and she will be written to by the end of april

    She rings up only to be told the company have no knowledge of her original call (what a surprise)

    They also inform her she will need to fill in this form they are sending in three parts, herself one part, jobcentre the other and her ex-employers the other... she didnt leave on good terms from her old job so how the hell thats going to happen I dont know.

    Are they within their rights to ask her to visit her ex-employeers and attempt to get them to fill in this form?

    Hello pmw, welcome to the PPIicon forum.

As they are making life difficult you IMO have a couple of options available. Was advised information would be put into the post to her. She followed that up with a letter also asking for the same just in case.

    This week she gets a letter telling her that her PPI complaint is being investigated and she will be written to by the end of april I would write back requesting they expedite the claim as you are still required to keep up payments on the card.

    She rings up only to be told the company have no knowledge of her original call (what a surprise) phone callsicon can be denied unless you can record the details, better to keep everything in writing, letters send recorded and copies of everything filed.

    They also inform her she will need to fill in this form they are sending in three parts, herself one part, jobcentre the other and her ex-employers the other... she didnt leave on good terms from her old job so how the hell thats going to happen I dont know.

    Are they within their rights to ask her to visit her ex-employeers and attempt to get them to fill in this form? Not sure about this question but you may get information here.....Employment Problems

    The options you have are:

    firstly try to keep paying the minimum payments so the account does not fall into dispute.

    Work out what PPI payments have been made for however long the card has been held.

    Depending on how much PPI has been paid and what the balance is on the card you could go down the route of cancelling the PPI (especially if it looks like they will delay paying out or refuse to pay out on a claim). Then claim back the PPI premiums and the interesticon on them as you can put in a claim that it was mis-sold if they fail to pay out.

    In some cases the payments claimed on the PPI would not cover the payments required on the card so the PPI would be totally unsuitable.

    The drawback on reclaiming PPI as mis-sold is the length of time it would take to get a full resolution it does not happen in days or weeks.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
