Hi,
in 2004 I took out a secure loan and was sold PPI for this. It was an upfront policy.
The sales person told me that I stood a better chance of getting the loan if I took the cover out and I was under a lot of pressure to take the loan out so I did sign. At no time was it explained to me that I did not have to take cover out or that I could take cover out elsewhere. There were no medical check forms etc.
I have recently SAR'd them and they have returned a copy of the application for insurance which was signed for on the same date as the loan was signed for, there is no further paperwork related to the insurance, no copy of the policy was included or anything else.
The application for the insurance states that I understand that the insurance is optional etc and that they have provided us with all the leaflets (which they certainly did not) to do with the insurance. It was signed by a witness but do not know who this is and presume it must be someone from the company involved.
It states that there is no cover for my spouse only for myself which is ridiculous as I am employed by HMG and they pay full sick pay and redundancy etc, it is my spouses employer that does not !
Do I have a realistic chance of making a claim, after reading many of the threads on here I believe that the PPI would not have been paid if I did make a claim for sickness etc as my employer pays.

The policy was through creditcare, does anyone have their address ?
The original application was through HFS but the specific application for the insurance was with the company that supplied the loan, does this mean that the loan company cannot wriggle out by claiming it's HFS's fault ?
Can some kind person check the figures out for me as I was left a little confused with the PPI calculator;
As stated on the paperwork;
Total credit £33,900 (including £3900 for the PPI)
Payable by 300 monthly payments of £308.53 at an interest rate of 10.50% (0.8350 monthly)

there are several addresses for the name creditcare you can search through companies house type in the name of the company and the results will pop up for you....this is the link to companies house...
Although this matches you will need to call creditcare to confirm they dealt with your policy. It is important you make contact with the correct company where several are listed.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc
