I have sent off the first letter to HSBC re. loan insurance, and have received a letter back basically telling me to shove it and I was wrong!
When i took my loan out it was for £4000 which i did online, at that point i had the forms through the post to sign, admittly i was a idiot and didnt read them, signed and sent back (i can hear you all now saying prat!! )
anyway, as im claiming my bank charges back, i had 6 years worth of bank statements to trawl through and noticed that when they paid the loan into my account they paid in £5000 and on the same day they took back £1038 which means i never got £4000 in the first place!
i took the loan out over 60 months, (ive got 2 years left on it) and on my PPI policy it states the insurance providers that pay out if you claim now for unemployment (which is what i would have wanted it for) it states the term of the loan should be LESS than 60 months, it does not say 60 months or less, it says LESS than 60 months! so am i even covereD??????
Also i was never advised once that i could purchase this cheaper elsewhere niehter!
they are disputing it all!!
so im not sure if im fighting a losing battle, what about the single premium policy thing? can i get them on that???

Also i was never advised once that i could purchase this cheaper elsewhere niehter! Have you asked them what the period of cover would be? If they come back and state you are no longer covered, then without having sight of your Policy and terms I would suggest you have a case of mis-selling. ie you paid for PPI on the understanding it would cover you for the full period of the loan 60 months if the PPI does not cover you for the full period of the loan then it was clearly not fit for purpose and certainly unsuitable for you.

so im not sure if im fighting a losing battle, you may be fighting a long battle but the way PPI has been extensively mis-sold probably not a losing battle, what about the single premium policy thing? can i get them on that??? IMO yes if the PPI was single premium then that is a good claim for mis-selling

You still appear to have your original Consumer Credit Agreement and the terms and conditions is this correct?
Keep at them, they will try and make life as difficult as possible and use delaying tactics all the way.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
