As I'm on a dmp and Sainsbury are accepting the reduced payments without anything in writing I don't want to rock the boat with the court action at the moment that I have with Link. I wrote to Sainsburys 3 times since April 08 asking them to cancel the PPI as if I was made unemployed and I'm on a reduced rate it would not pay out. Is it worth possibly rocking the boat at the moment in writing again to them as obviously its nearly 12 months and they've been charging interest on it as well.
Should I hang fire till this is sorted with Link or should I send another letter. There's been no threat of DCs or anything from Sainsburys. What you you suggest.
Obviously I will be claiming these costs back eventually.

If not now is the time to insist they cancel the PPI. If the policy would not pay out due to your circumstances then why keep paying the Premiums. Write insisting the PPI on th Credit Card is cancelled and ask for written confirmation that they have followed your instruction. Is it worth possibly rocking the boat at the moment in writing again to them as obviously its nearly 12 months and they've been charging interest on it as well. If they have failed to resond to your letters then now state you intend to complain to the Financial Ombudsman Service and if there is no satisfactory result from the fos you will lodge a county court Action against them claiming full repayment of the PPI premiums plus the interest on those payments plus a statutory 8% interest as has been awarded by the courts and indeed the FOS have sought to get this added to all settlements.

This is your shout and you should make the decision. If I were to offer a decision and you followed it and it went wrong then oops you see where I am coming from I will advise but not make decisions for you.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
Thanks alanalan - Me thinks maybe hang on a little while longer and see what happens with Link first - who knows they may back down - doubt if thats very likely.
