    Hi people

    Would really apprecate some help here.

    I had a warranty for 3 items with Currys mastercare/whateverhappens.

    One TV was written off as the screen cracked and they gave me vouchers. Then a second TV was also dropped by accident 1 month later and I know it sounds silly but it really was not intentional the PLasma and LCD TV's cost loads originally so Why would I even try??

    Anyway I reported it and they didnt comply with the T's and C's as they toook so long to fix/replace and then nearly 3 months later they called with an investigator who says that he only claimed X amount of times and my claims history is hurrendous with other items covered by that company, when it is NOT. So he said 2 TV's with a cracked screen, thats too much im refusing it on the basis of abuse/misuse/ neglect. When the damge was internal so externally the screen is fine it is just the glass inside that is cracked becuase of the drop....I was initally told vouchers would be given for the 2nd TV then they changed their mind...

    He also told me that its a service agreement not insurance agreeent so they could refuse to cover at nay time or something like that...

    What rights have I got.??? Please really need your hlep this 2nd TV cost loads and due to hosue work was dropped on the stairs. The first TV I was given a small amount of vouchers for it so lost out anyway, why would I damage the second intentionally...? He just said that so they can say under section bla bla we cna refuse....they have no proof it was abuse/misuse or neglect..

    Your account is very generalised and so it is difficult to make out what has really happened here.

    One thing which does interesticon me is these vouchers. What are they for? You don't way.
    You need to be a bit more helpful about telling us your story

    Sorry for not being clear. The vouchers are product replacement vouchers (they find a product with the same spec as that insured and then give you vouchers to that value) to be redeemed at one of their stores. They gave this for the first TV but as I said the 2nd TV was written off and no money/repairs/vouchers given.

    write an exact account of what happened how the tv was dropped excetera, add as much detail as possibly

    for example dont just write "i was holding the tv and my hand slipped"

    put exactly what happened for example "i was moving the tv off the stand to clean around it, i was holding it with one hand underneath and the other above, i lost my grip when the plug cable got caught and pulled it out of my hand, it fell around 1 foot which is the height of my stand and hit on the bottom right corner it then fell forwards onto the screen"

    there is an appeals address on the letter they sent you saying it wasnt covered..

    many of the appeals appear to go through you need to put as much detail in as what they use to determine weither is malicious or not is how much your account of the story ties into what damage was apparent on the tv

    for example if you say it fell on its front but theres a hammer sized dent on the back its ussually refused (not saying there is but its just an example)

    you should then get notice of whats happened with the appeal if they say they still dont beleave you then ask for evidence why they feel that its inconsitant, if they cant prove their point then press them for all there worth.

    Yes they now investigate this kind of thing regularly now. They are starting to reject claims if they suspect malicious damage or misuse of a product.
    You have to be very careful not to tell them conflicting stories or they will consider it inconsistant damage & rufuse to repair/replace.

    UPDATE; The TV which was rejected for the claim should have been sent back to me, but instead has been thrown in the bin without my consent. The service centre say that the insurance did not tell them, I contacted mastercare who say that since it was beyond economical repair there is nothing I could do with it, however, previously when they rejected the claim they said I might be able to get it repaired independently and so they would organise for it to be returned nealry 7 months later I still havent received mmy TV. I was threatened and told that if I take this matter further to court then I could risk being blacklisted on all insurance companies...(even though previously I was told they a re not an insurance but rather a service agreement).

    At the end of the day it was still my TV just because they rejected the claim does not make it their posession does it??

    Hi

    Has every little detail gone into this post? the only reason why is that with product replacement plans they either repair or replace an item but they only replace the item if it is under £100 or is beyond repair.

    Once you have made a claim you will need to check your T's & C's as sometimes once the extended warrenty has done its job (in your case replacement) it becomes voided.

    From previous experience cracked screens are seen as "Accidental Damage" an if it happens again they see it as a malicious act. So you will not see any vouchers, money, or replacement !

    Seems unfair but some people do fraud the companies this way and they put this in to help them not loose money, they look at the fact how many people will have a cracked screen / drop a tv under a certain amount of time.

    This is going to be hard for you to prove it wasn't malicious, as innocent as it seems you need to see it from their point of view and use that to fight your way though

    Yes. Every little detail that is necessary has gone into this post. I dont feel I need to explain myself, because what I am saying is the truth. I just needed some advice, and I dont feel that I need to go into further detail to get some help. The fact is that I made a genuine claim and it was rejected and now my item has been thrown away without my permission. That is the greater problem.
