You haven't had your goods delivered and it's not up to you to go hunt the neighbour. Tell WHSmith that you are still waiting for your goods and that if RM can't deliver to the correct address, that's not your problem.

AIUI RM or the courier are contracted to deliver the item to the address you request. Them leaving it with another address is not delivery, WHS should send a replacement.

The courier should still outcard though - otherwise, how do you know?

It's not really for you to have to go a chasing your neighbour.

You have a contract that says for the price of X you will have goods Y delivered to your address. You are still waiting for WH Smith to fulfill their side of the contract. The fact that it was sent to the wrong person is their problem, not yours. Basically, WHS are in breach of Distance Selling Regs.

Write to WHS stating that you are still waiting for your book and to despatch it ASAP or provide a refund within 30 days tops. The refund must not be dependant on the outcome of any investigation, so they cannot refuse to refund it on the basis that they think you are lying - they must instead refund the money and launch a separate action in such a case.

The fact that they have a signature of someone else other than yourself should speed things along for them and in a way they have shot themselves in the foot by admitting someone else has it!

If you get no satisfactory response, then it's a 7 day reminder and lba.

far as i care its peoples choice, last thing i want to hear about is someone feeling sorry for their own feelings , cant see why there is discrimination in the world were all people at the end of the day
