Has anyone had any success reclaiming their PPI when the provider was not regulated by FSA or a member of GISC & so not able to pass complaint on to fos?
I have a claim & they appear to be taking the P**s as they were not regulated by the above when I took out my card, they think that they are untouchable.

Can you provide more detail omitting all the personal stuff. IE which bank, date of agreement. A lot of bankers and card issuers are trying to wriggle out of repaying mis-sold PPI by whatever means they can.
I am not sure if you have looked at the stickies at the top of the forum but that is a good starting point to read and digest as much as you can before you commence you fight to get your money back. Please see this link it is huge and not all will be relevant to you but you will pick up valuable information to assist you.

The Ombudsman is an industry arranged service which is under-resourced, takes too long
I hope this gets you interested in getting you money back
I had a fight for 12 months but got back over £10k
so it is worth the fight even for the principle involved in the whole PPI mis-selling issue.

Bank charge successes:
Halifax - Full settlement incl interest.
HSBC - Settlement, goodwill no admission of liability about 75% of claim.
RBS - Settlement, goodwill no admission of liability about 70% of claim.
2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
PPI Successes
PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
2 claims settled in full with LV without FOS involvement.
2 claims settled in full with HSBC without FOS involvement
PPI Claims ongoing with:
Cap one Now with the FOS
Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

(Says who M &S or the FOS? )(If the previous information inluding the fact you have been told the FOS cannot take up your complaint has come from M & S then ignore this it is a way to put you off making a complaint to the FOS. So contact the FOS explain to them and let them tell you they cannot deal with the issue. Do not accept the word of M & S as spokespersons for the FOS.

Firstly have you made contact with the FOS? A lot of financial institutions were not regulated by the FSA until Jan 2005 but in a lot of cases depending on the financial institutions the FOS has been able to take up the fight. In some cases it has not been able to it then it is a matter for you to proceed to Court action but using this site to assist in the process through other forums.

I have just been reading the complaints procedure on the M & S website & it states that if you are not satisfied with the response for PPI complaints you can contact Hamilton Insurance.
I am going to send a letter to them, has anyone got any ideas of what to put in the letter to put my case across as I want to try to be polite & non threatening to appeal to their better nature.
