First off thanks in advance if ne1 can actually help me.
Ive received four letters/fines from the ncp about "failing to make payment upon exit from a barrier controlled car park." the say they have me on cctv footage, each letter is a fine of £100 which altogether is £400 which i just do not have at all!!!! I am 100% not goin to pay this, so im writing a letter to them to see evidence of my vehicle going through the barrier, they have stated they hav e cctv footage so shud i ask to see cctv footage and nothin else, not even pics etc? or shud i just ask to see "evidence" as im sure they will send me pictures but i cannot see how pictures can show me goin through a barrier without paying so could state to them that the evidence is not clear at all and i am not paying it? somebody also told me that its only the police and council that can enforce penatly payments on you? basically im asking if theres a way i can get away with not paying these stupid fines?
You're right - only the council and police can issue these sort of fines. The whole thing is a [problem].
• do not pay
• do not contact them
• ignore their letters, no matter how threatening
• NCP are well known here and have some shockingly fraudulant paperwork. They will simply give up after 3 or 4 letters from them and their debt collectors.
• they will not take you to court
• CCTV is irrelevant - it's just a hollow threat to make you fall for the [problem]
If you didn't pay, they're entitled to the money they've lost ie. a couple of quid. But they're demanding money they have no right to, so they can go and swivel.
Ignore ignore ignore. Don't contact them because they will know they have a potential victim on the end of their hook.

No point sending them a letter. Their eyes will light up and they'll pester you for longer because they think you might crack. These [problem]sters hate it when letters go ignored - it reverses their business model because they're shelling out for postage and details from the DVLA, but not making any money.
It's tempting to tell them what you think of them, but you're playing into their hands. It's a mail [problem] and they want you to get in touch so that they know they have a live victim.
so the ncp dont have ne right what so ever at all? the letters werent sent by recorded delivery so i could say i never received them as the percentage of post that goes missing in the northwest is fairly high and my letters might just be one of them! lol! how do you know all this stuff Al27?
so if i ignore them wont they proceed to send more and more and pass the it on? i quite fancied bein a cheeky sod with them and sendin them a letter statin they hav direct evidence etc but im will to pay the amount i should of paid when i was there , then say i parked up for 15mins so i only owe them a couple of quid , and state that thats all they will be getting lol!
rite just to make this 100% clear, i can totally ignore the letters, but i can expect more and more etc. do i just ignore them to? what happens if i ignore them and they pass it on to a debt collection company? do i say i never received the letters etc? or do i ignore theres to? could they turn up at my house and just take stuff? im not worried coz i trust what u say but on the other hand im worried i might get in over my head?
NCP, like all these private companies, are claiming that you have agreed to their terms and conditions and by breaching them you owe £xx. It is well established in law that this amounts to a penalty charge, and private companies have no powers to issue penalties. And by their reasoning, their terms and conditions could say you owe £10,000 and you'd have to pay. Which is rubbish! In theory they are allowed recompense for money they have lost by your actions, but their is no profit in trying to claim £1 or £2.
It's a percentages game - a lot of people will cave in and pay. Those that don't play the game get written off after a few letters.
The whole thing is allowed to take place because
a) the DVLA will sell virtually anybody's address for £2.50 a time, and pocket £6m a year
b) widespread ignorance, even from so called experts from organisations such as Citizen's Advice and Consumer Direct
c) the fact that nobody in authority cares that companies like these commit fraud on a regular basis.
The last point is of note, because these companies will always claim that they will take people to small claims court but very very rarely do. So they go to town with fraudulent paperwork because they know they won't be going anywhere near court.
So yep, expect some junkmail from NCP and their debt collectors (don't confuse them will bailiffs) before they give up. bailiffs are the ones who take goods, but that can only happen *if* you get taken to court *and* you lose *and* you still don't pay. It won't happen.
Debt collectors are nothing more than private companies like any other. They have no powers apart from writing letters. Home visits are a waste of time and petrol and they just don't bother.
From memory, NCP like to send out paperwork that pretends to be from a council (a Notice to Owner, Charge Certificate etc.) and use debt collectors like Graham White and Roxburge.
Hold on tight and don't cave in!
By the way, I suppose I know all this stuff from when I came for advice about a council pcn. Then my eyes were opened about the private parking [problem].
Personally, I've ignore a private parking co with great success. But remember that you should still pay for parking in the first place if you're using their services.
wow cheers matey! book of knowledge! can i not send them a letter with all that in it lol! well ill ignore them all and stand my ground, i dont have £400 neway to pay them even if i wanted to! stupid amount aswell!!! if theres anything else i shud know please let me know! ill keep ya posted on what happens but honestly thanks alot for your help!

hi guys, well as u might of read at the beginning i got 4 letters through. i also got 3 more after that aswell, i never answered them or nethin as advised by ur good selfs, they hav now sent me through letters sayin that if i dont pay in 14 days they will pass it on to a debt collect agency etc, what shud i do?
i also wondered if they passed it on to a debt collect company cud they get the dosh off u if u were declared bankrupt?
About as much chance as snow in Saudi!

So im guessing i can just ignore these letters to, they sent them noraml post so im just gona say i never got them, no proof so sod them! so how else can they get in contact? could they try ringin me eventually? what do i do when the debt collection company get in contact, just tell them to sod off i know nothin about it etc and hang up lol

They will next send the next level of Threatogragam, that is they will write using another name with the really scary words 'debt collectors' at the top. They might use RED INK and mention things like CCJ's, bailiffs, attachment of earnings etc etc. All Bow Locks!
They are (as you have been told) hoping you will buckle and cave in. Just treat them like like a silent fart. We all know it is there, but it will just go away.
By the way. This advise is not free. i charge £1000 for it and you agree to pay that by reading the above. Unless you pay me within 30 seconds I might bring in the debt collectors (oooooh) or get a CCJ (ooooooooooooh scary). I am going to use words like FINAL now and then Final final final (in RED? ink) and now I am going to threaten you with having your kids imnprisoned, your house visited by bailiffs and your name in the paper. All of which is about as scary as a picture of my 77 year old mum with a blue rinse. Have a laugh, ignore all of that crap they keep writing, wipe yer bum with it (although it is a little scratchy) and stop fretting. You owe them sod all so they get sod all.

What I would suggest is keep all their letters and then send them back to them in an envelope without any postage. They will then have to pay to get their c**p back :grin:
