    Default Netwarriors vs MINT - PPI taken without my authority

    I come seeking advice and a little clarity.

    After much of a debate with MINT, I finally SARicon'd them under Section 7 of the DPA1998. In the 'incomplete' bindle that was returned I noticed they had sent me a properly executed copy of my Credit Agreement.

    Now after reading on this forum about documents being recreated I checked the agreement very carefully. To my astonishment, the section marked PPIicon was marked as 'Not Selected'. No other documentation I received under my SARicon related to PPI in anyway.

    After checking my statements I noticed that for nearly 36 months I had been charged PPI every month.

    I have complained to MINT and they are currently nearly 4 months in failing to resolve the issue and have said that the PPI department are not regulated by the Banking Codeicon of Conduct and therefore not bound to 8 weeks before I receive a final response.

    Your help is required as MINT actually Defaulted my Account due to my bank removing my overdrafticon by 'mistake' last year which had a knock on affect and the time it took to recover from the late payments and dealing with Triton.

    I'm self employed and have taken a huge amount of time off to get this account rectified and finally managed to get my Default Notice removed from the CRA.

    My question is this - as MINT have been taking PPI payments without consent, Defaulted me for a balance that included the PPI payments they had been taking, and due to the amount of time I have had to take off to stop these clowns doing something else stupid - do I have the right to claim anything back? Have they committed Fraud?

    I have worked out that my PPI payments added up to about £700 over 3 years. What else do I need to take into account, and what else can I claim as compensation... I still owe a balance of around £2500 and so 3 years PPI payments plus interest makes a big difference to me.

    Do I claim just the interest that would have beee calculated onthe PPI they have taken? Can I also claim the Interest I would have received if I could have saved the amount in a savings account? Can I claim back all the time I have spent in relation to this account? Does it render any part of my Credit Agreement Void due to their behaviour and thus make the rest of the debt unenforceable? As I have other debts that could have been settled with this additional money and not fallen into arrears with them, can I claim anythihg for this impact on my finances?

    Any help in understanding what I am entitled to and how to proceed would be appreciated.

    I have been told by some jobs-worth at MINT PPIicon team that there is a recording of my agreeing to taking out PPI when I phoned to activate my card.

    I have asked for a copy of the call to which MINT have said they can't make a copy that is secure enough to satisfy the DPA requirements.

    I've said that I would accept a certified transcript fo the call, to which they have said they can't do that either........

    I've currently raised it with the fosicon.

    Any advice would be useful.

    Having read your first post and this one it is time to get your money back.

    If mint have a recording (doubtful) then the Financial Ombudsman Service can ask for this in response to any complaint you submit to them.

    Unable to answer this but they have certainly been alledgedly underhanded in the action they have taken on your account.

    You should have a good read through the stickies section at the top of the forum and go through all of the links to find more info.

    Once you have done the research come back with questions and we can take it from there

    I think MINT are trying it on but I cannot access all the available sites at this time of the morning to be able to do research.

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
