    • Hi I was being supplied my ovo after unknowingly being swapped from SSE.  My issues began when we had a smart meter fitted and our bills almost doubled overnight - we at the time assumed we were just paying not enough until then and just continued to pay the excess bills each. Month.    I would from time to time contact ovo and get faced with a call centre on South Africa of the most rude agents who would just hang up after hours of wait and I could not even get an acknowledgement of an issue with my meter.  At one point we were not in the property for like 4 months and the bills were coming just as high!  It was at this point I was sure something is not right and ovo only care to send bailiffs and started threatening us with a pay as you go meter despite me taking out a 3.5k loan to pay of my outstanding balance.  Around 1600 each on both gas and electricity.  This is where its gets really bad -  the very same day they sent me out a new bill saying the money paid already was only to cover up until the November previous and because its now Feb we owe another 1k.   By that August this had risen to over 3k and I still couldn't get anyone to even acknowledge a fault let alone fix it.    In despair I tried to swap suppliers and to my surprise octopus accepted us because even tho the debt is owed we are trying deal with.  During our time with them the bill was coming only on my wife's name as I was responsible for other bills and she this one - now that we owe them 3k they have magically started adding my name as well as my wife's to the same debt to apply double pressure and its showing on my experiwn report now with a question mark and 2700 showing in grey -  This was my wife's debt which we dispute we owe yet the have now sent me letter with both our names on from oriel and past due credit debt agencies - is this illegal and how can I get them to take my. Name of this and leave on wife's name as its so unfair they give us a both a defualt for wife's debt which we dispute anyway.    In the end about 3 weeks ago I wrote an email to their ceo and rishi sunak and low and behold for the first time in our history with ovo someone who spoke English contacted us and said she will look into our claim.    I explained to her that we feel our meter is faulty and despite me contacting them using WhatsApp email and phone I still have not got anyone to acknowledge a fault even. And that I dispute I Owe anything as my son was in hospital for 3 months and we stayed with him so house was empty and still. They were sending us super sized bills more than when we started at home.  She promised to investigate and a few days later replied that she is sorry for the poor customer service and offered us £50 compensation - however she also. Mentioned that she's attached statements for us confirming the payment for 3k I made was only up until Nov and in Feb despite me pay 3.5k nearly it's correct for them to bill. Me. Another £900 the very same day and she did not agree our meter was faulty and therfore the debt stands and she will not be calling it bcak from past due credit.  During my time with my new supplier post ovo, octopus I requested tehy check my. Meters because I felt they were faulty and over charging me and I got excellent response asking me for further details which I supplied and I got a. Response bcak within days to say my meter was indeed faulty and octopus have now remotely repaired it.   I then contacted the energy ombudsman and explained my situation how she at ovo tried to fob me off and demand I apy money we don't feel we owe due to faulty equipment we reported but ovo had to process or mechanism to deal with it or lodge complaint even without having to cc their ceo and our pm. And now I feel sick to think both husband and wife will get a 6  year default for debt which have a validity of a questionable nature.    I explained all this to the energy ombudsman and they accepted my case and I explained to them that my new supplier found my fault which ovo refueed to accept - I've uploaded the email from new supplier to ombudsman showing we had a fault.    My. Question is is there anything I can upload in defence of my case to ombudsman before they decide outcome ina few weeks    All advice greatly appreciated not only would I like advice on how to clear this debt but also how I can pursue ovo for compensation and deterrence for the future.  Thansk 
    • Thanks for the reply dubai 50 - if the statute is 10 years it has long passed - if it is 15 years i havea few months left. i shall ignore until it gets serious  An update - - I sent the letter to the bank in Dubai ( I did get delivery confirmation from Royal Mail)   - I have moved to a new address ( this is the address i gave to the bank in dubai)  - IDR are continuing to send Letters to the old address, which leads me to believe they are not in contact with the bank at all. - i have not replied to any correspondence digital or hard as they are non threatening ( as of yet).

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I stupidly took out a £100 loan with these in December last year. Basically I had to roll over the loan for a couple of months as I couldn't afford to pay. I checked my bank statement yesterday and found they have taken out two lots of £30.00 from my debit card(extension fee) on the 4th and 10th March. I called them yesterday afternoon and was told that the 'accounts department' would email me back within a couple of hours to let me know what happened. However, I still haven't heard from them, so I put another call into them this morning and was told an email was sent. So I asked to speak to them and the guy told me they couldn't do that and yet again I was told someone would email me back within 30 minutes (Still nothing!)

 

I'm worried about this as they've got my debit card details!

 

Any advice please would be really helpful.

Firstly, you shoujld not be talking to these kind of people on the phone without recording your calls.

 

Secondly, if you really want to protect yourself, tell your bank that you believe that your card details have been compromised, that you want the card cancelled and a new one issued. this will prevent any further access with your old number.

 

Pay day loans = death.

No one should ever get involved in these. It is a one-way street to complete ruin.

Hi there i applied to capitalfinanceone for a payday loan of 100 pound untill i got paid, i was declined for the loan, but on my payday they deducted my bank account the 100 pound for the loan and 30 pound interest when i didnt even have any money of them in the first place. I have sent them several emails to them explaining what has happened and asking for their response as i clearly want my money back as i owe them nothing anyway, i have rang endless amounts of times and nobody ever answers, Please help how do i go about getting my money back, when they will not respond to my contact.

I too have had various problems with this company, and I know where you are coming from when you say that nobody ever answers the phone. I get the impression that this outfit is just four guys in an office. I borrowed £250.00 from this lot and the day before I was due to repay it became neccessary for me to roll the loan over. The next day £75.00 should have been taken from my account as agreed over the phone with them, however, at 0100 hrs the following mornking they took £325.00 totally emptying my bank account the dat before my sons 16th birthday.

 

Upon speaking to them it was agreed with them that they had made a mistake and the £250.00 would be creditted to my account by FPS. That day no funds arrived, next day no funds arrived so I called them that they assured me that the funds had been transferred. Next day still no funds, called again and was assured once again that funds had been transferred. Next day no funds, upon callaing again I was told that unfortunately funds had never been transferred and I would need to take out another loan with them to get back the £250.00

 

After a huge argument demanding funds the same day I was finally browbeaten into asking for another loan. At which point I sai that I would certainly not be paying them any interest on the new loan as it was their mistake. They would not agree to this and I was finally forced into accepting to pay the interest, and a new loan agreement was to be sent to me.

 

Low and behold instead of a new loan agreement I received an email from their accounts manager informing me that my comments in the phone call to them had voided any contract I had with them and they had no intention of making me that loan, and it was pointed out in no uncertain terms by them that they would conduct no further business with me in the future, even though I had never defaulted on a loan with them.

 

It seems that my conversation regaing not paying interest was being monitored and recorded by the accounts manager. At no point was it stated that the call was being recorded or monitored, and it seems that the guys in the office had a good laugh at me pleading my case.

 

Sorry that I have gone on so but I do sympathise with anybody dealing with this company, and I would suggest that you maybe take your case to the FSA or the consumer credit council. When dealing with this lot ALWAYS RECORD THE CALL.

Hi DG - can you show that they entered into an agreement with you to roll over the loan?

 

Unfortunately this agreement was made over the phone, the only proof maybe that they seem to record their phone conversations.

i am having problems getting a refund from Capital finance for additional funds they withdrew from my bank account. I have sent several emails which are unanswered spoke to spoke to someone on friday and yesterday who assured me the accountant had looked into and refunded £95 back into my account. The problem i have is that due to their unauthorised withdrawal i am now overdrawn and will be charged fees for an unpaid direct debit. It has cost me over £10 in phone calls to them and that dosent include the time wasted in trying to get through to them as they do not answer the phone very quickly.

Is there anyone legally i can threaten them with who will pursue them for me?. I really dont think it is fair that they can treat customers in this way and get away with it. It is us that suffer.

TOday i found that capital finance one had taken the complete £130 pound out of my account after i had spoke to them to try and arrange a repayment plan as i would not have the funds available . As u can immagine i was outraged to find the funds gone and my account been left with a £28 fine for going over my limit. i wanted to find out if i was the only one so came accross this site and started to think this company is a fiddle when reading comments from customers stating similar situations.

 

Although i tohught calling them would do nothing after reading these comments i thought theres no harm in trying. I have just come off the phone and to be honest i was amazed .......they have cleared up the whole situation and are even putting some funds back into my account to put me within my limit at my bank and have apologised. I just thought as people are putting bad comments i wanted to make sure the forum was fair and i think capital finance have handled the situation better than most lenders would thats for SURE!

 

my advice if worth anything is use this company, everything should go smoothly and even if for some reasin it doesnt i can tell you first hand that they will do everything they can to help.

Whilst the funds may have put you bace in the black they didn't add the bank charge on did they? Therefore you are still out of pocked and should get the bank charge deducted from any further amount they claim you owe.

 

Again I agreem with other posters this sounds like an employee trolling, especially as the previous post was 9th June....

Be interesting to see if they are sending from the same location!

 

I think all these payday loan companies should have a 3 month loan system, where you pay the loan back over three months, with interest at standard rate ie 8%... and if you want to pay back more then a rollover fee is not applied to the whole amount only to the remainder of the loan.

Wish i had of read this before i applied for a loan with this company on the 12 August 2009.

 

I was informed i would get my loan and i should have it within 48 hours which never arrived. On speaking with someone which took several attempts as no one answered, i was told they where having tech issues, how ever this would be sorted soon. A week alter still no loan or update so i emailed to be told there was no time scale for this issue to be fixed, they gave me the option to cancel my loan which i did, with full email confirmation from them.

 

Imagine my suprise when my bank informs me that Capital one finance have taken a payment of £22.10. I emailed Capital one Finance who i must say replied within 2 hours!! They informed me this was a error thier part however they couldnt refund this amount at present because they where still having tech difficulties!!!

 

How do i get my money back??

Don't do payday loans myself any more as they're a death trap, but my brothers girlfriend took out a loan with COF and her experience exactly mirrored that of those commenting that they agreed a roll-over only to have the full amount deducted on the due date. She then had to agree another loan with them, which failed to materialise after 4 days despite being told that the money would be transferred at 5.30 the same day. When she called them, she was told the loan had been declined. Personally, I think that was blessing in disguise, but it caused them a hell of a lot of short term problems.

 

I don't quite understand why a business would make this sort of mistake multiple times, unless perhaps they're having cash flow problems and can't afford to take the reduced roll-over fee from their clients. I'd be a bit nervous doing business with them.

 

I also find all these people with new accounts highly suspicious....

A friend of mine reckons this lot could fold any day now hence their tech problems. We can all but hope! Don't give them your bank details under any circumstances. If you have to have a pay day loan don't use this lot. My mate works for their bank.

I've had a loan with these guys and think they have just taken an extra £300 out of my account, I can't get through on there telephone numbers and would like it back! no replies to emails either, anyone got another phone number for them?

I'm afraid I don't Danny, but if you go to:

And search the number you DO have, you may get lucky and also not have to pay through the nose for the call. Out if interest if you don't mind me asking, were you expecting your loan to be rolled over but they took the whole amount?

Their systems are crashing around their ears!

 

I applied for a loan from them a few weeks ago, got accepted and thought everything was fine. After about 4 days the loan wasn't showing in my bank account so I called them and they explained that there had "system issues" and to wait a further 48 hours.

 

48 hours passed, still no loan and told to wait 24 hours. The next day I had had enoguh so I called them again to find out what was going on and the lady explained that theire loan payments to customers from the past week hadn't cleared in the bank accounts and that the payments had been bounced back!

 

I cancelled the loan and made sure they sent me an email to confirm that the loan had been cancelled and that they wouldn't debit my card.

 

They also hardly ever answer the phone and they never respond to emails.

 

My advice is to cancel any loan you have with them if you are within the 14 days cancellation period.

This company have STOLEN a large amount of money from me. It has been over 9 days since they took back their loan and took extra money from my debit card - I have been told repeatedly that the money has been transfered back but nothing, now cant get in touch with them and the phone is just ringing out - Any sugestions how I get this money back

I know that they have sent out an email to customers this week saying that their system issues have been resolved.

 

If you still can't contact them, then I would advise you to go to your bank and explain what has happened. They should be able to escalte this for you.
