Illegal And Fraudulent Withdrawal From Account By Loan Shark
I need advice people,
A company loan shark withdrew oer £200 from my account after I had settled a loan. When contacted they could not explain why or who authorized this criminal and illegal access into ma account. They quickly volunteered to pay the money back. But i refused as i had already alerted ma bank having been charged £70 for going over my authorized overdraft.ma bank is currently investigating.its almost a month now.
I believe this company should be made to pay for material loss by way of compensation for the damages done,If they can afford to charge over 1200% interest, then surely there must be a way of making them pay for their blunder. your advice is highly welcome
Re: Illegal And Fraudulent Withdrawal From Account By Loan Shark
You should have accepted the money back. You are under a duty to mitigate your losses.
If the access to your account was accidental then it would not be criminal. However, it is of concern I would want an explanation.
Get them to repay your money and then start dealing with the problem of recovering your bank charges.
If the money was withdraw on a direct debit then you are entitled to recover all losses from the bank on the basis of the direct debit guarantee.

Got to agree with BF.
Your best course of action would have been to accept their money THEN fight to get compensation.
Why / how did they have the necessary account info' to be able to withdraw cash. ( i take it it was D/D, and again, as BF says if that was the case you are covered under the direct debit scheme.
