Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Camden Motors (a Vauxhall dealer) in Aylesbury has just gone into liquidation. My mum put a deposit down on a vehicle and was told that they would have it ready for her in a few weeks. She has had a letter through to say the car wasn't delivered because the company went into receivership. She asked for her deposit back and they refused, saying only that she would have to talk to the receivers. Mum paid the deposit by Maestro card HSBC. Please can anyone tell me how she would go about getting her deposit back?
The only hope here would be through the bank; if it was a visa credit/debit card you may be protected; dont know about maestro though! if its a debit card and has not got a gaurantee scheme then the goodwill of the issueing bank would be all you can rely on.
But please put a claim into the receivers anyway.
Thank you Raydetinu for your reply. Unfortunately, because my mum paid by Maetro (HSBC), she is not covered in any way and therefore she will probably lose her deposit, unless the receivers pay her the money she gave in good faith as a deposit on her new vehicle...which is unlikely.
The thing I find most difficult to understand, is how a company can take money from anyone, knowing full well that they are going into receivership. The general staff may not have known, but the accountants/managers would have. I think it's disgraceful that they could take money from anyone in these circumstances. That is not 'business as usual', in my eyes, that is is theft!
Camden Motors have been bought out by Paragon, according to the Bucks Herald Newspaper, who I would like to thank for printing my message from this message board in today's paper.
If anyone on here knows of any way my mum can get her money back, please could you let me know.
