Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Hello all, i've posted a link to my other thread, please see below.
Can anyone have a quick read through and see if they can advise me the best way forward with re-claiming these PPI charges back.
I really appreciate anyones help and advice xx
To claim the PPI back you need to write a letter to their compliance team asking for it back -pointing out that you didn't request it and any other reasons why you don't feel it was appropriate.
Send in a chedule of PPI premiums and a figure of how much you are claiming back. i am not sure how to do this for credit cards - mine was a loan and thats different
If you can keep you head when all of those around you are losing theirs try parking your helicopter somewhere else
I am writing to request that you repay all the late payment fees and/or over limit fees that have been applied to my account.
I do not believe the charges reflect the true cost to MBNAand are unfair and disproportionate. I am therefore requesting a refund based on the Unfair Terms in Consumer Contracts Regulations 1999.
This is supported by the Office of Fair Trading’s April 2006 statement into credit card charges, which noted that the level of charges at the time, and prior to that period, were unfair.
The charges total £--- plus compound interest at a typical rate of 16.6% thus totaling £---.
I have attached a schedule of the charges and interest with this document.
I would also like to draw your attention to the PPI product that was added to this account without my consent.
I can confirm to you that I never requested this to be added to my account and I stated so on my initial application.
The Insurance would not have had any benefit to me as I have a Pre- Existing medical condition that you would not have covered.
I calculate that you have taken £------ from me in PPI payments. I would like this amount to be paid back to me including compound interest (typical rate 16.6%) thus totaling £-----
I enclose a schedule of charges, which I am claiming with this letter.
As you can see the total amount I am claiming back for both lots of charges is £---------
My targets to resolve this matter
I will give you 14 days to reply to me accepting, unconditionally my request in principle and letting me know a date by which I will receive payment.
If you do not respond, or you do not respond positively, within this time period I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets should be more than sufficient for a large company such as yours with dedicated staff and departments.
I look forward to a full response to this letter within 14 days.
Yours faithfully,
Livis Livis
Any comments/advice are really appreciated. I'm particularly confused about the compound/contractual interest thing. I want to make sure i can claim for this and that i word things properly xx
