I bought a 2004 Audi A4 19 days ago from a "trader" in London. The car has a full main dealer service history and has covered only 44K miles.
A couple of days ago it started making a whining noise and after taking it to Audi I was told the gear box was "beyond economical repair". The car was sold with a 6 month warranty with a company called APA. I got the warranty thrown in with the car, the cost was not added on. I looked the booklet over and engine, gearbox etc was covered.
I have taken the car to an independent gearbox specialist who can repair the main bearing etc so does not need a new gearbox as Audi suggested (£3000). The cost was quoted at around £900 which was good as the warranty had a maximum per claim of £1000.
After the garage had removed the gearbox and rang APA to state the exact problem (as requested in the booklet) they were told that this was not covered under the warranty as case hardening of the gearbox was not sudden mechanical failure, and was excluded under general wear and tear.
I understand I can request the dealer rectify the situation under the Sales of Goods Act, however he is out of the country for another 2 weeks (a 1 man band)! My main issue is with the warranty company. The engineer repairing the gearbox has stated this is not wear and tear as the car has only covered 44K miles!
What is the best course of action? APA have refused the claim and when pressed further regarding the policy wording simply hung up!
A you have found warrantie are not worth yhe paper they are printed on!
44k miles sounds not a lot. check the VOSA site for all the MOT readings.
If it has done more this where you will have a claim against the dealer.
How long ago did you buy it? The dealer would be the one to go for, however you may be out of luck now as you did not refer the fault to him to put right in the first place!
The mileage is correct. I have all the service history and old MOT's and when I took it to Audi they confirmed the service history and mileage.
The car was bought 19 days ago. I have had to give the go ahead for the repair as I need the car and the dealer is out of the country for 2 weeks (according to his answer phone message).
You are quite right with this warranty, it is not worth the paper it is printed on! Wear and tear lets them get out of any claim!
