I had a pcn issued by one of those CCTV cars trouble is I didnt get the original notice.
Spoke to the council remembered when it was so yep guilty as charged but as I have been unemployed for 15months I forgot about paying it.
got a form PE2 & PE3 from council (order for recovery of pen charges)
Next thing I know Newlyn send me a notice of seizure dated 24/11/2008 for £193.16
I called them to explain that most I could pay was £5 a week as I was unemployed they refused this & said the usual stuff (seize & distrain etc)
I panicked & agreed to pay 15.68 a week (which of course I couldnt pay)
I decided to call them again in Dec in the hope that they would understand only to be told the debt had gone up by £120.75 & that they would now need the balance in full I said I couldnt pay.
My wife then phoned them to see if she could negotiate they said they would accept £15.68 a week (again I cant afford this)
Now if the debt is in my name they cant speak to my wife anyway can they? (Data protection act) but that is besides the point.
Can anyone help me as I really would rather not pay Newlyn at all plus the last communication I got from them was december 11th so who knows what charges they will have put on
You admit that you were guilty of the contravention and then ignored the Council paperwork All that has happened is that enforcement has continued and the costs have escalated.
You agreed a payment plan which you knew that you couldn't afford and then defaulted on it.
You either find the money to pay or lose your car - it's a simple as that.
This may not be what you want to hear - but that's the situation.
