Hello you lovely people, I would like to ask if we have any comeback to the dealer who sold us a car on 31/10/2008.
The car had been sitting on the forecourt for a few months, we were told it was a trade in, and it was sold to us" a trade in no warranty given"lights and levels check..They advised it needs a service. Well we had service and pre mot check, and the car has excessive corrosion to both front to rear brake pipes, and n/s/r suspension coil spring broken, steering off, cam cover gasket leaking, rear fog lamp not working, and others.
On the advert for the dealer it states 87 point check to ALL CARS.
I checked the vosa site and there should have been an advisory note attached to MOT.
I rang the company who sold us the car, and they lost their temper and said if it already had an mot, then they did not need to check the car!Then they promptly put the phone down on me.
We were driving a deathtrap it appears.
Hmm, any advise? We paid 999 for the car,i managed to get 150 knocked off when we bought it as it had no tax.
Repairs are estimated at 391 plus labour.
The car was valeted for us, and we asked about warranty, and they said they dont give warranties on trade ins.
The dealer even said that his brother had driven the car for a weekend and said it was a smashing car.
On previous MOT'S, which i checked on vosa, it states slight corrosion to brake pipes, but precheck said excessive,it also said fog lamp not working, only had the car 3 months, and we were advised the excessive corrosion would not have happened in the 3 months that we had it. It was already there...Sorry if i put this in the wrong place, but i'm learning

Statements like 'sold as seen' or 'trade sale, no warranty' are totally meaningless and do not absolve the dealer from his legal responsibilities when dealing with a consumer (as opposed to a business).
Short and simply, the dealer either needs to fund/do the repairs or refund the amount paid and you return the car. However, you need top bear in mind that the car only cost you £999 and you cannot expect it to be in 100% working condition. He is absolutely liable for anything that affects the roadworthiness, but I doubt for things like a failed fog light (not MoTable unless rear fog) and leaking gaskets.
You are protected by SOGA, not by any warranty from the dealer.
If the vehicle was unroadworthy (regardless of current MoT certificate) when he sold it to you, then he was also committing a criminal offence.
I thankyou, it just goes to show that even reputable dealers, are not always reputable when it means making fast cash out of unknowledgeable people like us, too trusting so we are.
