Thread: Bcard rec sars but no cca time for info com office?

hiya all

this is a second bcard

sars have arrived last week but without cca copy or relevance to the agreement with any terms or conditions - nothing

so have waited unti this weekend

had already send lba and advised them what was missing as originally way back around xmas got only the 6 yrs of statements.

So now points to consider

1. Report to Info comm office with details of what is stll mising, (cca, terms, statements or entries from when account was opened - only sent past 6 yrs)

2. Raise CPR 16 letter giving them a bit of time to come back to me - to appear really reasonable

3. Put a complaint into BCARD as i had specificially requested info on the cca and all account entries from when the account was opened, which has been totally ignored. Thus allowing them time to investigate?

4. I havent actually done a seperate cca request with the 1.00 because i honestly thought i would get it within the SARS - since i initially thought they had to supply everything they had..

Im asking could i do all the above or just which ones in what order first

i know this account is quite old late 80 's so wow i hadnt thought it was really that old

these are my thoughts for the time being , appreciate any feedback

Hi Angel,

1. Yes, do this and see if ICO is interested.

2. Do this as well as it'll cost you nowt.

3. Waste of paper - don't give them the pleasure of ignoring you.

4. Save yourself the £1, unless you REALLY want a set of impersonal T&C's.

If the ICO won't or can't help you, we'll hopefully know a bit more about how BC are d/w the CPR requests (or not ) by then, so you can decide how to proceed.

Yes, i agree now ive had time to reflect on this

1. Will raise a complaint to info comm office, sending my original request and my second request advising them of what id not had back
Also include my points what i consider still outstanding.

2.Will raise CPR16 as a very reasonable rquest, i wont mention this to info comm office until the time has passed then i can let info comm know of this when i send a second requst maybe - will come back later for advice on this aspect - (will continue to pay them for the moment as on a plan)

yes i agree, save my 1.00 and wont send in a complaint as i feel my complinat to ico will serve as a more informative impact.

just managed to update but after my post quickly got the sars info,,,only statements , and the sentence "This information we have enclosed relating to this account is all that we hold"

so like ts told me their default notice was a sham from their mates mercers,,,

as other creditors have taken over these past 10 days i feel now

complaint to ico, for non receipt of the credit agreement, yet still have time to comply with my cpr request,,,(as trying to be really reasonable)

complaint to oft for the way they are still attempting to call and still adding charges etc and trying to contact me by telephone

so guys to me surely this letter shows they DO NOT HAVE ANYTHING further to supply AND im wondering if this gets to court wouldnt this be a nail in the coffin so to speak if they suddenly bring the cca out for court visit????

Hi Angel,

You have to accept, rightly or wrongly, that BC have NOT been sending back a Credit Agreement in response to a SAR. You'd therefore be unwise to assume either that BC have no Agreement, or that they'd fail in court if the CA was produced.

So pursue this now with the ICO.

And follow on with the CPR route separately.
