    Hi Folks,

Sent the usual letter to M&S asking for the CCA information. They responded with this.

Here is my respnse to the above:

    27th January 2009

    Your Ref:P110326X

    Debbie Hughes,

Further to your recent correspondence dated 23rd January 2009. I am afraid I am unable to supply you with any further information regarding my identity to enable my legal request for information to be fulfilled than has already been supplied previously.

The fact that you have been writing to the above address that included a FULL account number and to me by name requesting payment towards the above account/sending statements has confirmed to me that you already have the correct details. This address and the occupier has been satisfactory to you in past communications therefore you have until 6th February 2009 (this date is over and above the 12+2 days usually allowed) to supply me with the information I am entitled to otherwise I shall make a formal complaint to the Information Commissioners Office without further notice.

I have contacted both the ICO and CCCS who have both stated that a signatureicon is not required under the Consumer Credit Act and they also agree that with the evidence above you appear happy that I am the person you seek.

To clarify the request I have also included a further copy of my original request. This request should have been satisfied by 28th January 2009 when I have the right to place the account into dispute.

    Kind Regards

    Here is their reply:

If the T&Cs page is the back of the application form in real life, then it is almost certainy enforceable as it will have your signatureicon on one side and the prescribed terms on the other

wondered what letter you sent, i got mine yesterday can't post since no way would anybody be able to read it.
its a 6x6 mirco film application form (about 1988) nothing on the bank
i got a sheet with bank details on and a copy of credit card t&c same as posted above.
mine says something about PPIicon at 54p-64p per £100 balance and see conditions overleaf section 2. Well they are no conditions

I wouldnt know as all they have sent is a photocopy - a rather bad photocopy of the application form. I cant recall how it was laid out but I would imagine it would be like the majority of people on here

How am i going to know if it is enforceable or not

When the Liberals and Conservatives were in opposition, they both agreed that banks should pay back high bank charges to customers. Nothing seems to have happened since they came into power as a coalition. PPI Insurance has been sorted. Now they should turn their attention to bank charges and help customers get exorbitant charges refunded.
