Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Finally got a reply from BC today followng my CCA request beginning January. They sent us an A4 envelope containing a load of printouts and nothing much else and then another letter today from a very nice lady called Elaine who said she valued our custom and here were our t&cs as requested.
Have fired off a 'not good enough' letter and will wait to see what happens. We are now in default on both BC accounts but they've not started hastling us yet although I don't suppose it'll be long.
Fired off the same letter to Lloyds and Cap 1 last week but no reply yet.
BC's T&C's is what you get from them just now in reply to a CCA request.
Have you read up on the alternative strategy of using a CPR request. See Link No2 in my signature below.
Have you quantified the amount of penalty charges made on this a/c - you can reclaim these from BC regardless of the Credit Agreement.
They'll repay charges quickly if you don't claim interest at the Contractual Rate. If you do claim the higher interest, you have to be prepared to File at court, prepare Court Bundles and they'll only settle just being a final court hearing. The rewards, however, can be substantial.
Have you been paying PPI on the account. If so, you can look into whether this can be reclaimed too.

Yes, it's the CPR request that I've now sent to them. So far as PPI is concerned, I was paying it for a while some time ago. They definitely missold it to me 'cos I'm on incapacity benefit and registered disabled so there was no way they would ever have paid out. I cancelled it once I got my head together and realised !!
I need to SAR them really but money's a bit tight at the moment and to be honest I haven't got £10 to send them. Once I have, I'll get on to it.
