    Default Firstplus PPI - Need advice on whether to wait??

    Hi, we are due to have our premium paid back to us in June, as it will have then been 5 years since we took out the loan.

    We firmly believe that (like probably everyone else) the policy was missoldicon and after having successfully reclaimed from RBSicon we are keen to reclaim on this policy too.

    The question is would it be better to wait until we have had the premium paid in June or go for them now? Could going for it now lead to delays or even non-payment of the money we would be due in June?

    Hi I am not one of the experts on this site but I would say start your reclaim. They do like to stall but you never know they may uohold your claim depending on your case before June.
    I am at the stage where I have just refused Firstplus's offer without admitting that they mis sold it was put that it is a good will gesture.
    I think more like lets see how much she will go away for.
    If I don't get anywhere with the letter I have just sent then I'm afraid it's the the fosicon for me. That bit apparantley takes a time.
    Good Luck SARicon's request is the first thing to do.

    Thanks Varda! Good luck with your claim. Trying to weigh it all up - going on holidayicon in august and could really use the guaranteed payout money then. Just would hate to get tied up in a lengthy battle for this :?

    Hi, just to let everyone know. . . . .

    After writing just 1 letter to FP, they have upheld my complaint after just 6 weeks and sent a very apologetic letter :laugh:

    I would appreciate some advice on what to do next though because I'm a little unclear on what they have offered me.
    They have offered to give a full refund of the insurance premium of £6,178.30 plus interesticon paid on the premium to date of £2,454.36 and apply this back to our loan account.

    They will also reset the loan back to as it was without the PPIicon ever being on it. And will send us a cheque for the monthly payments we have made toward the premium of £2,841.20


    Now, I'm not complaining - far from it, but I'm unclear, should we not also be able to request the interest that has been paid be sent to us? or does this have to be applied back to the loan? Or do I shut up and accept whats been offered?

    Simply that they did not explain that the premium would only run for 5 years and that we were not made aware that it was an optional policy. It really was a simple letter stating just that - I hadnt yet even requested any additional info from them.

    I do not have a definative answer for you as PPIicon reclaiming is a complicated issue

    If the PPI is applied as a single premium and then has interest added you should be able to have that paid back to you by a personal cheque.
    Providing you have a valid claim against them for mis-selling and single premium PPI is one of the valid reasons.

    I would write back and tell them you will accept the refund in the form of a personal cheque made out to yourself.

    If they respond negatively then you could bang in a complaint to the fosicon. This will take a long time but it does work I was made an offer of refund by cheque to myself and refused I then complained to the FOS and got the refund they originally offered with the interest and 8% statutory interest on top.

    example the offer on the table was £2,600 payable to me by cheque. Offer refused complaint submitted to the FOS. Next offer was for £3,800.

    The choice though at the end of the day has to be made by yourself and it would be wrong for me to advise one way or the other. I have given you an example only of my own case.

    Additionally if you go the FOS route and fail you still have a Court action available providing you have all the documents.

    Every complaint to the FOS costs the company complained about £500.00 but only after 4 complaints have been submitted against that company. I guess they will have to pay up the £500

    I have no legal training and the advice I offer is a matter of support. Before you commit to any Legal action you are advised to contact a qualified legal practitioner.

    Bank charge successes:
    Halifax - Full settlement incl interest.
    HSBC - Settlement, goodwill no admission of liability about 75% of claim.
    RBS - Settlement, goodwill no admission of liability about 70% of claim.
    2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did
    PPI Successes
    PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.
    2 claims settled in full with LV without FOS involvement.
    2 claims settled in full with HSBC without FOS involvement

    PPI Claims ongoing with:
    Cap one Now with the FOS
    Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.
    LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

    1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

    Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.
