Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My partner and I are in a financial mess, we are in rented accomodation and have £30,000 worth of debt on credit cards and loans. My husband was made redundant last year and has had to take a job with a lot less pay. After struggling over the winter making minimum re payments we have decided to contact Payplan. That is in the early stages, they are now writing to our creditors with a payment plan. We have £300 left to pay them each month.
However despite having made a move to sort all this out I actually feel worse I am constantly worrying about what is going to happen next, I am waiting for the calls to start as I have only paid them a token payment this month. The people at Payplan have been great but still I feel absolutley terrible. I cant focus on anything, I cant eat, I cant sleep, I could just sit in a corner and weep. I have even had chest pains last few days, I am putting this down to stress.
I am frightened to death that they will try to made us bankrupt, although we have no assets at all so I think if I am right that would be a bit silly of them. Hubby just keeps saying it will be ok, sometimes I just think well what will be will be but it only lasts a few minutes then I am back to worrrying again.
Sorry for the long post, but I am in a real panic over this, has anyone any wise words that I can keep with me that will give me the courage to face all this mess?
Thanks everyone, reading the forum does help a wee bit !
Hi. You have my sympathy. I can relate to everything you have said.
I can also relate to your husdands remark that everything will be ok.
One step at a time.
Firstly, are Payplan going to charge you anything at any stage ?.
If so why pay to do what you can do yourself.
If you are in rented accomodation, its unlikely that any of your loans are secured.
Are they enforceable at all ?. Apply for copies of the original agreements.
What is your fear of Bankruptcy ?. I went BR for a similar amount last Nov.
Its SUCH a RELIEF.
.
I Wish you everything you wish yourself.

NatWest Claimed £1,639. Accepted £1,344.
Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.
Barclays 1 Claimed £1,260. Won by default. Paid in full
Barclays 2 Claimed £2,378. Won by default. Paid in full
Birmingham Midshires. Claimed £2,122. Accepted £2,075.

Petalica, they're very wise words from Tonycee xx
We were in a dmp with Payplan. It half-helps, half-doesn't, because it's hard to feel in control of the situation.
We will not be intimidated.

Look at all your options, but don't let this make you ill.
You can sort it out, and it will be okay.

BIG SNAP HERE , after lossing my business and debts getting bigger over £80k i filed for BR on 23rd Feb 09 using this web site helped alot and when i went to court they were great very helpful, the judge was a very nice PERSON and under stood everything.
Since monday i have slept every night lol, the creditors are not happy ( thats business ) i was very ill before going BR and now a feel much better, debt free and now enjoying life, but going BR is not for everyone so think hard and if their is no way of repaying the debts and your in a rented house you may already know the question
Thank you all so much for your kind replies, I am trying hard to gather myself together to see this through and am dealing with it a day at a time at the moment. Last night I got everything together and rang Payplan this morning who are sorting out a repayment programme for us, I will just have to see if it gets accepted and if not... well I will have to deal with that when it happens. I might even find the courage to send off for the original agreements yet

Its painless, and may be the best few pounds you have ever spent.

keep posting you will start to feel much better the people on here are good listeners x
I and many other reading this will know where your'e coming from. One thing I would say to you is do not get ill about it! REcognise the signs and take actions - don't be afraid to go to the Dr's for some medication. This is the one time you need your health.
I have had what I call a fuzzy head for months - not being able to concentrate - not being able to do much but cry and think about debt and how usless I am to be here at this point - then one day I though enough is enough and off to the Dr's I went. I take v mild sleeping tablets some times - if I can't sleep and also v mild tablets for anxiety / mild depression - do I feel bad about it? NO some people manage better some don't - I need to cope I have children. Do I still get anxious - yes - Do I still feel sick on occasions - yes Do I still worry - Yes BUT IS IT 24/7 NO! I took control before it took control of me.
Please do go along to the Dr's or if not try some self help like meditation ( if you can clear your mind that is)
Try and put things in to it's place - one day at a time - you will be alruight because you are not burying your head - you know you have the debt.
Don't think too far ahead - look after yourself - don't let your anxiety excalate into some big depression.
This site is a brilliant place to let off some steam - talk openly.
Please take care of yourself and keep your chin up (which chin would that be!!)
Gosh, thank you all sooo very much, your kind words made me cry so much I am going to be here for quite some time I think, it is so heart warming to know that all you people out there who I dont even know can be so kind and supportive. I will keep you all informed with events, they have alreadt started, had a default notice yesterday!
Don't cry hun you'll smudge you're mascara!!! just remember we're here to sound off too.
There are so many people in the same situation and If I had'nt have found this site I could have gone a different way ,but I have my lovely hubby and 3 gorgeous kids no-one can take that away. These people think they are above the law by making people sick to thier stomachs with worry
You've made the first step contacting payplan, take care off to do a cca request for MBNA let the fun begin x
My situation was the same as yours only difference was that it was back in 2004. I then approached payplan and that was my first step they took on everthing even if the so called creditors started to hound me I would just forward it on and playplan would deal.
As I said that was four years ago and I have now completed my dmp and paid my creditors off part from two who have no credit agreement but that is another issue.
What I am trying to say is that there is light at the end of the tunnel and you will come through, you have already taken the first big step.
The people on here are great and they will give you any advice that you ask and before long you will be strong enough to tell these so called DCA's where to get off!
