I've had a vehicle on contract hire with RCI Financial Services since September 2007, unfortunately I started to have some money problems towards the end of last year, and wrote to RCI to advise them of this.
In my letter of 07/12/08, I advised them that I would be unable to make payments on the account until February of 2009, and asked them to extend my original 3 year agreement to take into account the missed payments. I also asked them to freeze any interest or charges that were being applied to the agreement, until such time as I could resume making payments.
I had a letter back from the in early January, advising that they were refusing my proposal. They say that they left a message on my answer machine as a follow up to that letter, though I don't recall this, and a further letter was sent to me in late January advising me of the defaults on the account and the further interest and missed payment charges that were being added to my balance.
I've now found myself in a position where I can make an immediate payment to them, to clear my arrears, and continue with the agreement, but have been told that they have now cancelled the agreement and will be appointing agents to recover the vehicle.
Once the vehicle has been recovered, it will be sold at auction, and the sum recovered deducted from the full outstanding balance on my account, leaving me to make up any shortfall.
Can anyone offer any advice as to what my rights are in this situation, and whether there is anything that I can do?

I purchased a new car through RCI Finance in Nov 2006. A couple of months ago I looked into a part-ex deal and the garage could not find any information relating to the HP Agreement and the amount outstanding.
I have looked into this and discovered that the vehicle registration plate and the one RCI have for the vehicle do not match. They have one letter missing from the registration.
Is the agreement still legally binding?
Any advice would be greatly appreciated as I've recently divorced and payments are becoming difficult, before I do anything I'd like to know if they have defaulted the agreement in any way?
