Hi, I'm new to the forum but have been looking in for a while.
Great place and great advice. I always feel good after reading a few threads.
I sent a CCA request to Egg on the 20th Feb
My payment was due to go out on the 22nd but I stopped the DD as last month it sent me overdrawn at the bank. Didn't need that again this month as things have changed and don't have enough money going in. No work for a while.
They signed for it on 23rd.
Had a call from them yesterday but I was out.
Got a call this morning and after all I read on here I still got into a conversation..
Was supprised that he didn't want any security except for my name.
When I answered the phone I was called by my first name and I answered yes, then he asked if it was me by my full name.
After that he told me he was from Egg blah blah.
I ended up by saying goodbye but he did say they will call again soon.
What is the best thing to say to them when they call?
That because of the ever present threat of identity theft you no longer give out such private information over the phone.
If they then discuss the account with you then you ask them how they know it is infact the account holder and that because they have not verified that they are in fact giving out confidential information.

I asked him how did he know he had the right "my name" and he said this is the telephone number I gave them..
so, no other checks just my name and then he started the usual can you make a payment routine. Told him no then said goodbye.
Just after re-assurance haven't done anything too wrong.

if they try the name thing again I'll let them know that my father and son also have the same name as me and can and do use the phone in this house.
So a name and telephone number does not mean they are talking to the right "Tom Sawyer" for security. After that just refuse any personal information.
I don't like just putting the phone down. I would feel like they had won something. I can't wait until they call again now.
This morning I got a phone call from Egg, wouldn't confirm my name so he gave up.
Also got a letter asking me to sign the request.
Although the later does state that it is not a legal requirement.
Anyway, I would like to send them this

Thank you for your letter dated 25/02/2009 the contents of which are noted.
In your letter you make reference to requiring my signed authorisation before you comply. I draw your attention to the fact that the Consumer Credit Act 1974 does not require that I supply you a copy of my signature before you comply with my S77/78 request.
If it is for Data Protection purposes then I can happily supply you with documentation to substantiate my identity to you.
However please note that to date you have happily sent correspondence containing extensive sensitive private information to my address. I have to ask if you are concerned that you are corresponding with the correct person why has it taken so long to raise this matter?
As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998:
7. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.
My request for a true copy of my credit agreement under section 77/78 was made on 20/02/2009 and the 12 working days for your compliance expire on 10/03/2009. I note that there is no provision that removes the requirements of the act to provide this information on time, even if you are unsure of my identity.
For your records I enclose the same request including the same Postal Order with a copy of the letter you returned to me at this address.
I look forward to receiving the documentation requested

Right, they signed for the second letter on the 9th (signature thing)
Time ran out today for them to send me my CCA's.
Should I send the account in dispute letter now as they have not sent my CC agreement yet?
I sent for my CCA from Mint as well on the same day. Have not heard a thing from them but Egg phone nearly every day..

crossing in the post I have my first letter back for the second time, again asking for my signature.
What's my next move?
I was thinking of an e-mail containing a phone call recording of them confirming who I am over the phone.
Also sending them the postal order back through the post.
Is there a letter I could send to tell them to stop messing around with my request?
I don't understand why there is such inconsistency at Eggville these days-I got all my stuff without a signature, I did include a copy of my drivers licence and utility bill.

what i find iritating is on their letters they even say that it is not a legal requirement. So what's the point playing letter tennis with a request and postal order. They are clearly flouting fos regs.
Or am I missing something?
