    Default Capital One decline PPI...what now?

    Hi folks....hope someone can help me please.

    Had a read through some of the posts but cant find anything suitable....Wrote to Capital Oneicon begginning Feb requesting full refund of mis-sold PPIicon.
    Got a reply today from them which (I think) is a cop out...

    to cut a long story short is basically states i was sold the PPI during a phone callicon with them where i had the option to listen to a limited version of the terms and conditionsicon and also was sent full details in the post (cant remember if i got either to be honest)
    It states the product was optional which was made clear to me (I am positive this was not)
    They state their telephone scripting is clear, fair and not mis-leading. Capital One would not have made a recommendation I took PPI (I would never have requested this)
    I had a 30 day cooling off period and could have cancelled at any time.
    They are not refunding any of the premiums...

    Sorry for the long post tried to put as much from the letter in here (dont have a scanner so its all mannually typed lol)

    Just really wondering if anyone else has had this and where do I go from here? I'm new to this having not attempted to claim anything back before and wonder should I write to them again....and what to say?

    Any help would be greatly appreciated...thanks

    Have you sent them a Subject access requesticon letter ?

    I think you need to get hold of the telephone recordings from them as it is them that has to prove this too you.

    The S.A.R letter should get you all this.

    There is a template letter in the stickys at the top of this forum there is a £10 statutory fee so you will have to include this with the letter and sent it at least recorded delivery and get a postal receipt.

    You have to allow them 40+2 days to do a search of there records 2 days are to allow for postage.

    Hello just wanted to say that I received the exact same letter from Capital Oneicon.

    I too was sold PPIicon during a telephone conversation but my call took place on the 5th of the month, my account didn't open until the 17th

    I sent Cap 1 a SARicon and guess what? no evidence of this so called conversation not even a computerised record of the call being made. The CCA wasn't signed either and the box wasn't ticked for the ppi.

    Needless to say I have wrote requesting a full refund (only £200+) or I will go to the fosicon.

    Good luck with this and don't be put off by their letter, it seems it is just a template one.

    yep
    its just a standard letter trying to put you off.
    they won't have the phone script they never do.

    issue them with a letter detailing exactly the amount you are claiming and give them 14 days before you start court proceedings

    they will wriggle but pay beforecourt date
