Hi, just need a little bit of advice, I have receieved a letter from Egg today saying:
Thank you for your recent request to us, we were however, unable to process this request as the application is not signed. Egg places paramount importance on the security of the client data. Please note that your signature is not required by law for a section 78 request, and you providing it to us is purely to allow us to identify you as the owner of the information and therefore entitled to receive it. Please sign and return if you still require this information.
Would I be right in thinking that they have used this address for the last 5 years to write to me, send statements etc. Can I send them a utility bill as proof instead?

Send them this letter . I'm in the process of doing this. You shouldn't have to send anything to them. If they send you a letter it goes to your address. If they send you a CCA it goes to your address. Just because you sign/don't sign a letter doesn't mean that it won't fall into the wrong hands!!
But to speed things up I'm sending them a secure message through the website with the recorded delivery barcode. Can't argue with that! Unless someone has hacked my account...

they are satisfied that the person that they have been writting to for years is intitled to recieve that information,but need sig for cca request
send them a STATEMENT BACK
and tell them that they will find a copy of your sig on the cca....

Hello, I have spotted that the wording is slightly different to the letter they sent me for my SAR-they did not mention that it wasn`t legally required and they were just asking for their own sake-I wonder................... ................is the fact that they are only saying they need it before sending docs out (with out stipulating it isn`t a legal requirement)perhaps a little naughty??? Are they misrepresenting the law???? I will have to check it out-it isn`t the first time they have changed the wording on their letters because they have made a big mistake.

I have sent out my letter today so we shall wait & see what they come back with, it is funny really they had no problem sending me out the last 5 years of statements without any questions to my identity / security!

Any news yet? Egg have done exactly the same to me. Just received my 'we want your signature so we can cut and paste it onto an agreement' letter yesterday.
Wishful thinking but do you think this is a sign that they clearly dont have your agreement?

This is all a bit wierd. When I requested my CCA I signed with a shorthand version of my usual sig and signed it across a date stamp.
Got my agreement back and it was the true original signed copy.
In fact I've had three true original signed 'agreements' back from 3 different credit compnies (I have quite a few credit cards and catalogues ) using that ploy.
I don't want to explain just how I asked for the CCAs, suffice it was NOT the usual "go for the throat, by law, I'm entitled" route
If I told you, anyone reading could link my request with my user name.

I sent them a photocopy of my drivers licence (sig blanked out) and a copy of a utility bill with a mildy sarcastic letter and they are sending out my SAR.

Hello! New member here and I've had the same response from Egg. It must be their 'excuse of the month'. Best part is they sent an annual statement to me that same week without being asked!
Must rush off now and send them a polite (unsigned) reply. Think I might include a copy of that statement to wind them up a little!
I will start a new thread explaining my situation soon so you all can advise me.

I logged into the secure website and left this message:
I recently sent you a letter by recorded deliver requesting a true signed copy of my customer Credit Card agreement.
Under the Consumer Credit Act 1974 (Sections 77/78), I am entitled to receive a copy of this agreement upon request. I enclosed a payment of £1 in a postal order (which you have returned) which represents the fee payable under the Consumer Credit Act. This payment is strictly for the payment of the Card Agreement and is in no way a payment towards the account.
You had 12 working days from receipt of this letter which was 25 February 2009 to comply with my request. If this request is not complied with then under the Consumer Credit Act of 1974 you are unagle to enforce an agreement as you fail to comply with the sections of the Act.
You appear however, unwilling, or unable to comply with my request and have asked for a signature. As you clearly point out under section 78, I do not have to supply this. By clearly sending the requested Credit Card Agreement to the Address on the letter, which also complies with the Address on the account you can clearly identify myself as the owner of the information. Also receipt of this message via the secure messaging service you can be confident that the of the identity owner of the card.
I look forward therefore to receiving my Agreement, as requested within the 12 days which commenced on 25 February.
The letter and postal order will be returned to yourselves, by recorded delivery to complete your paperwork.
This appeared to get through to them as they replied with an apology, albeit they said that a CCA would be sent within the next 12 days, of course I put them right on this and insist that if I do not receive a reply by 16 March then the account will be in dispute.

Unbelievable! When I sent my CCA request I got the "require a signature" letter back. I replied saying I would send a secure message which verified the details of my reply letter and that it should satisfy their concerns. It did not and they came back not only requesting a signature, but documentary proof I am who I claim to be!
Oh! And in my secure message I asked if it could be passed on to the Data Request Team. I got a snippy reply saying they could not!!

I have just had another reply back to my curt telling off to them regarding the dates.
I apologise for the delay in sending the Credit Agreement to you. Please be assured this will be sent as soon as possible to you
Again I have stressed that they must comply before 16 March or I will put my account into dispute. I also added that they must send me a fully compliant and signed CCA. And asked if they are unable to do so to let me know asap.

They don't know the ar$e from their elbow at Eggville and don't have a procedural response, I got my CCA without signing my letter, but they wanted a sig for my SAR request.
Ho hum, all this fannying around will look good if they have the balls to take me to court

Egg are in default of my S78 request because they keep fannying about asking for a signature. Should I send the £1 postal order they've returned (twice) with the default notice? Or is enough enough and they've had their chance?
