Hi All,
I received a very interesting letter yesterday from HFC regarding my PPI claim.
Now, I must explain that the loan I originally took out with them was paid off early (re-written) against the account I claimed against..
I am concerned this has now been transferred to the new loan account and also as I know I have completely different information regarding the original loan. Can anyone tell me if I can claim the rebate back from early settlement as they were never given to me they may have been applied to the new account?
The offer made to me was approx £1,000 with some rather confusing figures at the bottom of the letter- I will give example:-
Now by my calculations based on the paperwork they gave me at the time of taking the loan I am actually owed approx £2500 (PPI) but then I was also charged approx £5,000 in interest charges? Am I able to claim this back also?

Thank you for your letter dated February 2009. In the letter you have offered a 'full refund of Insurance policy plus interest charged', may point your attention to your reference regarding my early settlement. In this paragraph you state that an early settlement figure was calculated which included rebates of insurance premiums. Please send me all correspondence and documents relating to my acceptance of the cash rebates detailed on your letter as I have never received any cash rebates, so these too are owed. To my calculations, the sum offered is considerably lower to what was actually charged to me when I initially took out the policy. Life & ASU detailed in your letter are incorrect against the information sent to me by HFC previously. It is based on the information provided to me by your company regarding my loan I have calculated that HFC bank owe me the sum of £2,500(PPI ) +£5,000 (interest applied with loan) + 8% statutory interest that a court would award.
If you are willing to refund the correct amounts detailed herewith then I will agree the revised settlement and I will draw a close to this matter. If you disagree, please provide detailed information on my account including my original signed agreement.
I will give you a further 7 days with which to respond after which I shall be taking my complaint to the Financial Ombudsman.

I really need some assistance here... I sent a letter to advise HFC that I would accept their offer as part settlement they have written to tell me they will no longer be responding to me as I have apparently 'exhausted the Banks internal complaints procedure'.... Couple of things I want to check, they have made me an offer which I suspect is considerably lower than they information I have in my possession. If I sign their agreement to accept this in Full & Final Settlement, will I no longer be able to claim?
I have asked them to send me all literature concerning my account and they have never sent me anything?
Really really need some help here, I need to know if I am being taken for a ride here..
A ride yup id say so i haven't seen a company yet that gives a correct refund in there first offer time to take the complaint to the next step but bear in mind that the fos is snowed under with PPI claims and the last i heard there was an 18mth backlog.
so it all depends if you are willing to wait that long if not your only other option is court will be quicker but there is a fee to pay upfront which of course you will get back if you win.
FOS will cost you nothing and they do uphold 80% of claims but as i say theres quite a wait.

Thanks for both getting back to me, I have sent the information to the fos... I had waited to hear back to find out what step to take next so I have just gone ahead and done it.... Let's just hope & pray it doesn't take that long, but I am prepared to wait, after all, I know they have done wrong..

What's the percentage of successful claims taken via the court system, anyone any idea. Also is it a much quicker route as some of the courts a extremely busy at the moment.
I have no idea, I am sure someone may be able to shed some light on that one.. I am sure the delay is due to a backlog of case which were on hold due to the test case for the charges?...
