Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have a secured loan with Welcome Finance, wrote the first letter from templates on here to say I feel I was missold the PPI, they replied that this was not their concern, it was with 21st Century Finance who arranged the loan, so I wrote the same letter to 21st CF. I have had this reply:
"The policy was sold on a non-advised basis and you were given information only in order to decide whether you would like to proceed with the policy. You were informed verbally that the insurance was optional and this is shown on the credit agreement and also on the quotation. We provided you with a policy summary and document which clearly states the benefits and exclusions and this is confirmed on the credit agreement which you signed. I have enclosed copies of the credit agreement, demands and needs and quotation for your records. If you are dissatisfied with my response you have the right to refer the matter to the Financial Ombudsman Service ..........."
Most of this is untrue as a representative called at my house with papers, said "sign there" to the documents and was gone in 10 minutes, but how can I prove this?
Talk to the fos on the phone for an opinion, they are quite good up to a point.
Personally I think you could have a problem, check the documentation fully and check to see if on any documentation you have signed and dated it says, ~'You have been advised that you could obtain PPI for this loan from another provider' or 'There is no obligation for you to take out the PPI for the loan to be approved '. Also check to see if the PPI was taken as a single premium and added to the loan total.
Post up the documentation you have here minus any identifying info including dates even remove the company if you want to, so you can get an opinion.
I just got an offer of all my premiums plus 8% simple interest, not good enough taking them to court for fair use interest even the FOS agree their offer is derisory.
