I had a robot call tonight and it said if I have a loan or CC taken out before Aril(?) 2007 it may not have to be paid. I hung up and wasn't going to discuss it with them in case it was a sneaky trick. I do have a loan that was taken out and I had a letter form one agency about it last summer. it defaulted in june 2004 and the balance is currently just under 6k. i spoke to them on the phone and offered £100 a month, but then after advice on here got the £100 refunded and requested the CCA etc. they wrote ot me saying they would not provide it so were passing the debt back to another collection company. In November I had a visit from them asking for 7k. oh ahng on here it is, not. he was asking very direct questions as htough e was recording the conversation, and when he asked if i had taken a loan out from a certain bank, i said yes i had done many yeras ago, but it was for a different amount and it was not this loan he was chasing. i told him i want a copy of the CCA before i do anything else. i have heard nothing frmo them.
today i got a letter from ANOTHER company chasing an old mobile phone debt, which i genuinely have no knowledge of, and they say it was passed to them by Arrow (who the loan is currently in the hands of i think). I had a letter fomr arrow about this mobile phone debt a while ago and did a CCA request, that was 3 months ago and i heard nothing back, but they cashed the cheque for £1! anyway, the mobile debt is for £315 and if it DID turn out to be mine (which I honestly don't think it is) I'll offer them monthyl payments or see if i can get a discount to clear it. i'm doing a CCA to this latest company that are asking for the mobile money.
as for the loan, does anyone know if it is a certain part of old CCA's that make them void/unenforcable? I mean, they need to produce it first to prove the debt, however i still have the original tucked away so if they pull a fake out or one with other terms and conditions on it then they're very naughty...
sorry for the waffle!!!! anyway, if i scan that loan T&C's, is there a way of someone taking a look at it for me? some websites are offering to do it, but they want about £500 just to lok at it with no promises, yeah right!

I've told the mobile phone people not to send anyone, they don't have my number and i've said i'll only communicate in writing. i liek the way they reckon they'll send someone to visit without making an appointment, and if nobody is in they will add charges to the account for a missed visit lol.
i was sorting through paperwork tonight and found 2 letters fomr a 3rd company after the mobile money, but it is for a higher amount than it is now!?!? it's an absolute mess, different people chasing different amounts of money for the same debt. oh well, i'll see if this CCA yields anything. should i follow up the letter i sent to arrow for the last CCA 3 months ago which they ignored for this debt?
hmmmmn, is there anything i should do then to fight this one in particular?
Short of denying any knowledge of it and telling them to prove it?

A lot of the older CCAs were/are unenforceable because they do not contain the prescribed terms i.e., APR%, credit limit, repayment terms etc.
There is an advert in our weekly freebie paper from a company stating that they can wipe the balance off credit cards as they state that 8/10 pre-2007 credit card arrangements are unenforceable.
the mobile debt , as above, is not covered by cca.
