I am now waiting to counter claim depending on the outcome of the Court Test Case before further action,
Has anyone heared about this Test Case if so can anyone give an update on the case.
Dont let them walk over you even if they reposess your car FIGHT BACK!!
From what I understand there is a final pre-trial hearing imminent on this test-case, and an update will sent out to relevant parties in due course.
I concur with what is said about fighting every case tooth & nail, and would also add to any parties fearing (at any level) possible 'repo' to hide their vehicle.
Incidentally, it was brought to my attention by someone that last week a case brought by LBL against someone who had previously accepted a part 36 agreement in settlement of their claim against LBL (very much a retaliatory claim) was struck out by a District Judge as being an abuse of the court process - he went as far to say it was an attempt at 'legal buggeration'.
Hi , just a quick post to let you know i had a car repo'd by LBL a few years ago , they pursued me for the outstanding balance for a further three years .
I got in touch with a solicitor who took on my case and after about a year they have agreed to cancel any outstanding balance , remove any entries on my Credit report , give me a letter to remove the bill of sale from the vehicle in the High Court as long as i agree not to pursue any further claims against them or other parties involved.
I agreed with this with the solicitors advice to bring this to an end and to have one less thig to worry about.
If the test case had given a better result after going through courts then i would have continued to pursue for anything i could have got from these low life scunbags.
Maybe with them wanting me to agree not to pursue any claim at a later date it means that they are worried about something they have seen or heard somewhere.
If you are having trouble with these scumbags then don't lie down & do nothing , FIGHT,FIGHT,FIGHT.
Seek advice , keep every document , dont give up.
