Re: BARCLAYCARD is CCA ENFORCEABLE? Morgan Stanley, Mercers
My oh received a similar cut and paste job from Barclaycard (originally Morgan Stanley application and card) - I started my own thread 'Morgan Stanley - Bcard' but am interested to see a similar application to ours.
Again on A3 and the 2nd page does not relate to the first page.
We wrote back to Barclaycard - Legal and Regulatory compliance - no response yet- 3 weeks
We mentioned in letter the absense of 'condition 16' on the 2nd page of supposed terms and conditions and also the illegibility of the document, not sure what the next step it.
Slick132 mentioned doing a SAR and investigating penalty charges, can we do that if we are contesting the existence of a compliant CCA? I don't want to be too cheeky but the telephone calls are now incessant and the callers quite threatening.
What is our next step?
When I get the statements should I collate for a charges claim or how does it work, I can't see logic of claiming agreement unenforceable then claiming charges - or then again maybe I can.
