    Unhappy CMS - Help please with appealing a ticket..

    Hi

    Please can someone assist with an appeal I wish to lodge regarding a ticket I have received from CMS.

    Basically I use a car-park close to our office, and pay the managing agents £45 pcm by standing order. They issue you with a disc to display and they last a quarter.

    CMS are the company who patrol the car-park

    All payments are up to date. The problem lies with the fact that when i taxed my car end of January, I accidentally put my new tax disc on top of the CMS disc in that holder.. so i was driving around with both out of date and current tax discs both on display (one holder is above the other).

    I subsequently received a penalty ticket for £50 due to non display of a permit. Their ticket states they have issued this on behalf of the landowner.

    The landowner indeed hold evidence that i am entitled to park there, the details of the vehicle i am parking there and that my payments are up to date.

    I have taken photo's of me removing the tax disc uncovering the CMS disc..

    Do I have any chance of winning an appeal?

    There is NO appeal.

    You have a contract with the land owner, end of story.

    Whatever you do, don't send these idiots a penny or you will never see it again.

    Hi there, please read around the forum and the stickies-all of what you need to know will be here for you. Heres a bit of backgroung knowledge though.
    Private Parking Companies (PPC's) mostly (it seems) exist to [problem] the motorist by issuing frivolous tickets just to make profit. The 'fines' they issue (the pcnicon you have) are not fines but invoices. They are relying on contract law (which is tenious at best) and if you read around the forum you will find that almost all of those who follow the advice on here ignore and do not pay. This method is proving ultimately successful. Appealing is your choice (as is replying for any other matter) but almost all appeals get rejected as they are done 'in house' so guess what they outcome will be!?
    I am not familar with CMS personally but perhaps some of the other posters will be and may be along shortly to help further. Best wishes

    This is a private company, hence there is no appeals procedure. No company will turn down profit.

    The original ticket is a [problem]. An unenforceable invoice.

    • do not pay
    • do not contact them

    CMS are easy to beat. They send a 'Notice' and then a 'Final Notice'.

    Then they give up and go away.
