Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Just wondered how many of you have joint accounts or am I the only sucker here? Did a very quick scan through forum and couldn't see any info on joint accounts.
When sending off the data prot. letter for list of charges, do we both need to sign it (as I suspect) or will my signature do? Don't want to wait 40 days and then have them tell me we both should have signed.Thanks.
Hi, on joint accounts ONE signature will do as long as either of you can sign for anything on it ok?
I QUESTION THEREFORE I AM!!
Unfortunately i'm not an expert in any given field legally and my advice and that of the Consumer Action Group and the Bank Action Group is given without prejudice and without liability so please if in any doubt whatsoever seek help from an insured qualified professional. Contents of my posts are purely my own personal opinions and not condoned or endorsed in any way, shape or form by CAG. Thank you!
Started my claim on 1st July.
Sent off request for charges on 9th July. Sent it to Peter Townsend at Radbroke Hall.
On 13th July got reply from Mr Townsend stating what I understand is the usual blurb i.e "bank is under no obligation....copy statements supplied in next few weeks.......without charge....etc.".
My cheque for £10 was returned.
Am now waiting for statements to arrive.
Hi Shell,
Perhaps we can keep in contact and compare notes on our progress? Got to say, I was hoping Barclays would have sent the list of charges so that I wouldn't have to trawl through years of figures but I guess that was too much to hope for!
Finally got statements through from Barclays. Got just over 6 years worth on both my accounts(personal and business). Will now have to trawl through them and see just what I can squeeze out of those 'bankers'. Will keep you posted.
Long time catching up with you all but here is where I am:
PERSONAL ACCOUNT:Sent off PAR on 15th September (was otherwise very busy) and got no reply. Have allowed them more time than I should have due to being busy but today have sent off lba. Will keep exactly to 14 day schedule this time. Don't want them thinking I am slack.
BUSINESS ACCOUNT: I am keeping accounts totally seperate and so am fighting on two fronts with same enemy. Can't yet work out what Barclays owes me as the statements they sent didn't list the individual charges made. All charges including account fee, interest charges, penalty and paid in, etc., etc. were bundled together as "commission" and therefore gave no indication as to what the penalty charges alone might be. I wrote again to Barclays and they repeat they are under no obligation to reply in any particular format and suggest I obtain info from my local branch who "will be experienced in the application and format of the Bank's charging process". I bet!
They go on to say "The Bank does not retain copies of Advance Notification of Charges advice notes"I think not!
Anyway, have been to local branch and am waiting for 6 years worth (girl nearly cacked her pants) from them.
By the way.
While I was in the bank I cancelled my "Additions" account and went back to normal account. I bl**dy well refuse to pay an £11.50 account charge so that Barclays can sell me stupid little insurance titbits without asking first if I want them!
Anyone else wanting to cancel the Additions part of their account and save £11.50 a month need only pop into the local branch and all they do is revert it to a normal account. You don't change account or numbers or anything. The girl told me hundreds of people are doing it just in my area. (and she agreed it was wrong, too.)
yesterday I received the standard "sorry to learn you feel bank charges are unfair" letter...blah blah..but without admissions of liability, I am willing to offer the sum of £750 towards the amount you are seeking...blah blah..avoid inherent cost and inconvenience...blah blah...Full and final settlement.
Will, of course, write back and decline offer and continue with claim.
Has anyone experienced problems with Business accounts? Barclays dont break down the charges on my biz account, they just lump them all together as 'commission'. I have had the run around from them in regards to obtaining 'advanced notification of charges' sheets. Knutsford refused to supply them advising me to see my branch. My branch dithered. I eventually phoned head office who today advised that they only keep copies for 3 years.
Does anybody have a suggestion as to how to find out what the charge were for the preceding 3 years?
Barclays have entered a defence which basically says that I knew the terms & conditions when I opened the account and that they are within their rights to recover losses. They also say that anything pre 2000 is not recoverable due to" exhaustion of time in bringing contractual claims from the date of accrual, pursuant to the limitation act 1980"
The court has sent me a letter ordering that a bundle and skeleton argument should be sent to them by 14th March 'and upon lodging of the trial bundle the court will consider the listing of the matter'.
Is this normal? No trial date until they see the court bundle?
Sat up till 3am this morning preparing my court bundle.
Anthony Lombardi from litigation called early afternoon to offer full settlement. Standard acceptance letter (via email) sent. you know the stuff: ...we still don't accept your argument but I'm sure neither of us wants the court fees so we make you this offer as long as you keep your mouth shut etc. etc....
I hope you have scored out the "keep your mouth shut" part, otherwise, you already are in breach of your confidentiality agreement, which is not a wise move. Although technically, you are not bound by it until you have your money back. Just remember that once you have been gagged to get YOUR money back, you are legally bound not to discuss it, not with family, not with friends, not with anyone.
IF you haven't sent the acceptance form back yet, I suggest remove the confidentiality part before sending it back. They'll pay up anyway.
Congratulations. ;-)
Apologies to people who I was in the process of helping, I may be gone some time.
Thanks for reminder, Bookworm, yes I certainly did cross out the confidentiality part and I increased the sum they offered by £30 quid. They claimed they weren't allowed to calculate the interest themselves so that's why they came up with a different figure to me but would accept my figure as being correct. Told 'em I wouldn't accept it paid into my Barclays account either. Wanted a cheque. They agreed.
Now to continue with account No 2!
well done!!!! I too have Anthony Lombardi, but my case isn't being heard till April, so I won't be hearing from him till mid March, I can't wait. ~ I am still planning to put my bundle together, just in case. do you know if I can send the bundle anytime before the 14 days before hearing or does it have to be exactly 14 days prior.
