    Default Mis-sold ppi - Sainsburys Visa

    Hi folks. Does anyone know wether I have an argument for missold PPIicon - ?

    Some arguments I can think of include :-


    Missold PPI ?
    PPI (Sainsbury’s Creditcare Gold) was arguably a condition of accepting the card i.e. no choice was given. See the bottom left side of agreement “What insurance do you require ? Sainburys Creditcare Gold”. Arguably It is also not clear whether this is asking you a question but not giving you a chance to say yes or no, Hence PPI was missold ?

    interesticon / charge for PPI not stated ?
    The charge for PPI is not specified on the agreement. Yet over 30 months I was charged approximately £700 for Credit care insurance. Note: In each monthly statement, at no time is the charge for Credit care the same as the amount charged for interest. The PPI charge also varies with the card balance.


    PPI inclusion is not made clear in agreement ?
    I believe the reference to CreditCare Gold insurance is inconspicuously included at the bottom of a section headed CARD CARE REGISTRATION. It is easy to think the whole section refers to Card Care insurance. The tick box refers to Card Care insurance (which requires a one off payment of £15) . Card Care insurance is in fact different from Creditcare gold insurance.


    Any comments would be much appreciated....

    1. What do you think the 01Y hand written means?
    2. Where did you complete the application form?
    3. Was the policy and its exclusions explained to you?
    4. Did they check the policy was suitable for you?
    5. Did you ever get any policy docs from them?
    6. Did you get notice of your cancellation rights?

    Why 3 lots of interesticon on 18.4.06?

    The PPIicon is worked out at 79p per £100 on the outstanding balance on your statement, that's why it's different every month!

    re: point 1, I haven't a clue as to the meaning of "01Y"

    re: point 2, the application from was filled in online for a loan. There was no online application for a credit card. The credit card agreement form was just posted along with the loan agreement.

    re: point 3, Following the online application for the loan, there was a phone callicon from the sales rep to confirm the loan approval and to verify my phone number, I believe she said I had also qualified for a credit card which would be sent out to me to sign, however I cannot recall any discussion about credit card PPIicon policy or any exclusion details.

    re: point 4. See point 3.

    re: point 5. I did not receive any policy documents for the PPI. I therefore do not know the policy number or whether one was ever issued.

    My SARicon request failed to produce any insurance policy copy or any information relating to it - although I specifically had requested this.

    re: point 6. A copy of the Credit Card Agreement did have a 'right to cancel' section, however in the Credit Card Agreement it appeared - to me at least that acceptance of the insurance was a condition of accepting the card.

    Well, I would think you have a case of missold PPIicon on your hands.

    If you SARicon didn't turn up and PPI info, I'd guess they don't have any.
