Hi

We are being pursued for a debt of £86 from South Lanarkshire Council which we were unaware of and goes back 13 and 1/2 years. We have no proof that we have or have not paid this as it is from so long ago. However we have had a similar claim a few years previous from Renfrewshire Council for £124 which went back 6 years, but luckily we still had our payment book as proof. The company pursuing the debt is Buchan Clark and Wells, they stated they had sent correspondence to the solicitors who dealt with our sale and they have not sent it on to us. we have contacted the solicitors who state this was not the case, and they are trying to locate our file to check if they have any knowledge of debt. We are being harrassed with phone calls and letters threatening court action and visits, even although we have stated that our solicitor is checking on this. Do we need to pay this debt or is it time barred. We were told by someone that Council Tax is not time barred, but surely after 13 and a half years with no correspondence something is amiss.

Council Tax is not time barred but in order to pursue the debt via the courts then a Liability Order must have been issued within 6 years of the bill. Once granted the Liability Order remains in force until the debt is cleared.
