    Default arnold clarks mistake

    I phoned arnold clark last monday to order part for my car. I paid by debit card on phone and asked for specific part my mechanic had written down for me.
    I kept phonin on days they said it would be in but to cut story short, it never arrived until today.
    I phoned my mechanic who went to collect it and wen he came to see me he told me it was wrong part and therefor no use to me. He said I should take it back and get refund then order the part I do need.
    I went to arnold clark garage and spoke to boy in parts dept, he said they dont do refunds and he ordered the part that I asked for.
    I asked for Exhaust Gas Regulator but they ordered Exhaust Gas Regulator Valve instead which cost £120 plus vat. He said thats wat I asked for but I know I never because I didnt know such a thing existed cause Im ignorant about cars and also I have piece of paper that mechanic wrote on and it specifically says Exhaust Gas Regulator.
    Anyways, I now have a part for a car that I dont need but surely they must be able to take it back and give me refund seein as it was their mistake, even tho they wont admit it.
    Wen I explained to the boy today that it was wrong part, he went into the back office and came out with diagram of my car engine and asked me to point out wat part it is I need replaced, my son (trainee mechanic) was with me and wen it was pointed out, the guy had cheek to say yes thats a regulator you need.
    can anyone tell me my rights on this?... Am I entiteled to refund?
    Any help or advice would be appreciated...Thanx

    they should take it back but they may charge you a stocking fee as it was by the sound of it a special order part as to who's fault it was that would be hard to prove without a phone recording.

    If you asked for an Exhaust Gas Regulator and the garage ordered Exhaust Gas Regulator Valve instead, tell them where to go....it's their fault !

    As dx100uk has stated earlier, use Sale Of Goods Act.

    If they still won't budge, ask your debit card company to do a "chargeback"

    wat is a chargeback?.... How do I go about it?
    I thot maybe a letter to glasgow head office of arnold clark may get me some results, does anyone think I should do that because the guys at local branch are very cheeky and wen I said it was their fault not mine, the guy just walked away into the back office and because they had other customers, I had no option but to walk away with the part they wouldnt take back.....
    Maybe Im bein silly but I used to use them every 6mths for car service until they broke my car key and I then had to pay £297 to get new key and then another £80 to get it coded to my car wen it arrived..... I was so peeved off I took them to small claims court and won so now Im thinkin they just bein rude to me because I done that 3yr ago.
    It was bleeper key and it worked wen I dropped car off for service but they foned me 2 hrs later to say key wont work but it must have worked because I left car locked in the street and wen i got there, my car was in garage forecourt with doors open..... the key was bent and the black casin of key was very damaged... My car was left with them until key arrived and it cost me almost £600 for that car service not to mention hirin a car for over a week till key arrived due to my job.... Thats why I took them to court and own.
    Anyways, can they get away with this, I cant keep a part for a car that I dont need and definately didnt order

    seems a shame you had to go back there!

    chargeback is via your card co.
    phone them up and tell them the part was the wrong one & the supplier is being funny.
    they should refund the amount, and you just take the wrong parts back.

    Car parts don't work like that, they send it back to the factors, so no restocking involved.

    I work for a van dealer and it says on our invoices that "Goods specially ordered cannot be accepted for credit. Returned goods may be subject to a handling charge". It is the Manufacturer who won't take the parts back, so the dealer probably doesn't want the part sitting on their shelf, gathering dust. It might say that on their invoice too and if you signed for the part I'm not sure you would have a leg to stand on.

    Yes, but it can't have a blanket meaning to 'all' situations, especially when they ordered a part not asked for by the customer.
    An exhaust gas regulator is hardly a special order, it is almost a service item.

    why should I keep a part they ordered wrongly.... It was definately their fault and it was my mechanic who went to collect it and he didnt have to sign anythin because the guys at the garage know him thru other customers so they gave him the parts in a bag with the invoice in the bag....It was only wen he got to my house and took parts out the bag that he felt the weight of the boxed part which was the heavy valve which we didnt need..... The mechanic immediately told me to take it back and get it exchanged for part I do need and thats wen I had the bother in first post above....
    I have done done anythin yet regardin this so some help would be appreciated..... The part I do need is due to be delivered tomorrow so do I take the valve thing back and quote my rights or just fight with head office over this issue....Thanx

    When you go back to collect the correct part, ask to speak to the manager.

    Explain that a member of his staff ordered the incorrect part, you are returning it under SOGAicon and you are collecting the correct part.

    If you fail to gain any satisfaction then write to their Head Office stating the details.

    ok, I collected the part for my car today and mechanic fixed my car...Alls well in that dept thank god.
    I asked to speak to manager and was told he wasnt in today but I know he was cause I phoned earlier before goin up and the lass said he was on a call.
    Anyways, I have typed up letter and am sendin it recorded delivery tomorrow and hope to get an answer quite quick but wont hold my breath.
    Will keep you all updated but thanx so much for all help...much appreciated
