I purchased a 3 yr old fiat Punto on 16th jan 09. Yesterday the engine just cut out.
I called the AA, who told me the issue was with the crankshaft sensor, which had been taped up!
I have 1 yrs warranty on the car and they recommended which garage to take it to. The garage have informed me that the wiring has been cut and a new plug added and glued to the sensor, plus other welding in the same area.
I am obviously not happy about this and ideally want to return the car to the dealer as when speaking to garage, they feel that this will be an ongoing issue as damage has been made to the earthing part. The AA said that the garage would have been aware of this as the bodged repair is obvious.
The warranty does not cover the checks the garage has completed so far which amounts to £50, which I have to pay.
Before I speak with the dealer, I'd like to know my rights in regards to returning the car as unfit for purpose
The dealer should pay for the repair under SOGA. did you refer it to the dealer who sold you the car as they are responsible for putting it right and you must give the chance to do so.
Do not think this is grounds for rejection in IMHO.
It wouldn't be unfit for purpose, but 'satisfactory quality'
Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.
If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)
Glued on sensors is not really of satisfactory quality, and as it was like that when purchased, did not conform to contract at time of purchase.
