Ok so I recieved my statements, and after having much fun with a highlighter pen (not normally fun looking through bank statements) I make the amount due to me £1147. So sent sent of my preliminary letter 1 week ago. Got a response today, 'Fair, reasonable and transparent, blah, blah'

So have sent of the final warning letter today giving them 7 days..... roll on next week!

    I'll keep you posted.

    Lol

    Hi there

I have also had my reply off them today saying that they have no intentions of refunding me etc etc. I'm a bit worried but am assuming that this is the standard letter they have been sending out to everyone who has claimed. Gonna start off my own thread see if I can get some help cos not 100% sure about the stage after lbaicon. I've been surfing the site for a few weeks now but there is that much info on here it's quite hard to take it all in to be honest and working full time and looking after a family also doesn't help. Just wanna say good luck and keep us posted I will be following you thread as you are at the same stage as me.

    X

Yeah, I'm not really 100% sure what to do after these 7 days either to be honest, all looks very confusing, but I've posted the letter anyway. I'll start having a look into it in the next couple of days, however in an ideal world the bank will come back to us both and say "here's your money" (ha, in my dreams)

After the 14 day prelim and 14 day lbaicon you register with moneyclaim online (search on google) you can then do your court claim online, you will have to pay the fee but this gets add to the total they owe you so you don't loose out. There is a step by step guide on this website, it even tells you what to put in your court claim.... good luck!! check out the frequently asked questions section!!

Thanks very much for the advice . I recieved a letter yesterday basically telling me to **** off.

So now I am ready for action, I have downloaded the spreadsheet for interesticon charges. But (as usual ) I have a couple of questions.

I've read that much information here I think my head will explode....

Do I have to make my claim under £750 and file 2 seperate claims?
Can I do a Summary cause summons? (if so, what the hell is one)
Or am I just plain stupid?

The charges I am claiming are for £988.19 and I am in Scotland (which I think is where my confusion has come from)
    Any advice gratefully recieved

I'm at the same stage as you just about to loadge court papers but am under the £750 threshold. I would recommend breaking into two seperate amounts to go the small claims court if only because more people have done it on this forum so there is more support but I am not sure of the implications for you if you loose a summary cause. If you see the small claims through to the end and loos eth eonly thing you are liable to pay is the initial fees.

Thanks, I kind of thought that. To be honest if I break it down I will have one for £750 and one for £250 so its not that bad. By the time I come to the second one I will be an expert (ok, maybe not)

Ok then, Monday the bank gets it!!!

    Cheers again

Good luck! Can I ask what court you are going too? You can PM me if you don't want it on the forum!! I'll be either using one in Glasgow or Kilmarnock!

I'm not sure, I'm in Falkirk so I need to check where it will have to be. I thought it might be Edinburgh as that it where there registered office is. Or is it where 'I' am? Have you heard anything about RBSicon closing accounts? I need to sort another one out this week too.

I've looked through most of the threads but there isn't a great many settled against RBOS (who posted on here anyway!) so I'm not sure if they'll close account or not. I've just been paid which gives me 4 weeks to get an alternative account and divert payment of my wages if they do close it! I think you can lodge proceedings in any court in Scotland as if it has an RBOS branch near it, it is within the courts juridiction. May be wrong but I think this is the case!!
