Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
In june last year i was driving my first car Corsa. I was travellign down a country lane and at the cross roads i was following a white 4x4, he sped off quickly and i was going 25 - 28 mph.
i cought up with him (staying at same speed) then going round a corner he sped up and as i went round the corner at 30mph (approx) he slammed on his breaks. i noticed about 6 police officers and they flagged him down and as he slowed down, they waved him on and stopped me.
They claim that on thier hand held speed gun i was doing 40mph and was escorted to the police car.
While i was getting a griling and givern a fixed penalty of £60, my wife over heard the coppers question whether it was me or the car in front. They didnt know.
I have been to court as i scrapped the car and lost the yellow slip and forced to pay £90. Is there anything i can do about it now, im not sure.
As far as the court is concerned, you've paid the fine (which is a full admission of guilt) and the matter is closed. There is no way you can reopen this, after the event. Your wife may not have been a credible witness in any event (not unbiased), however your legal representative could have challenged the police evidence and cast doubt on it, and this opportunity has been lost.
