My daughter sent a Subject access request to Barclays about her Morgan Stanley account, in mid January. Today she has received a list of copy statements, for a man living in the West Midlands. She, by the way, lives in Hampshire!
The account numbers are different - as you would expect. His is a visa card, hers is a mastercard. The only thing they have in common, is a surname.
Now is it just that they have put the wrong cover note in with the statements, and Mr X in the West Midlands has my daughters details, or judging by the other postings, is this a regular occurence for Barclaycard?
As Sal says, you should draw this to the att'n of the ICO, enclosing the other guys data for them to deal with.
I'd also drop a line to the other guy enclosing a copy of the letter to the ICO.
Then a letter to BC, enclosing copy of ICO letter, and say:-
In the circumstances, please send me within 14 days the information which you are required to supply in accordance with my SAR, a copy of which is enclosed for your information.

Spoke to the Information Commissioners Office today about another subject, but mentioned the fact that Barclaycard had sent someone elses info to my daughter. Was advised to send it back to Barclays and let them deal with it. Apparently the ICO will only tell Barclaycard to make sure their procedures are all working anyway.

Hmm I didnt follow through with my thought on contacting the press due to myself not officially being the aggrieved party.. perhaps we need to find out numbers of people this has happened to and then see if it needs to be raised publicly????

I did mention to the guy at ICO that their making sure that procedures were in place, were not working with the Government or various banks, who are losing data daily. His comment was that they can increase their penalties if they repeatedly fall foul of the law. I guess that means taking their sherbet dips off of them!
I shall still get my daughter to send all the info with a complaint to the ICO, and let the guy in the West Midlands know as well.
