    Default BoS credit card - no agreement

    hi there,
    I am new - so I hope I am not in the wrong loop with this:
    I have not found any special threads re credit cards: I took out a BOSicon credit card in 1999 with them and after a period of some financial difficulties they have 'closed' it, on my statements is now shown a strange amount as to be repaid per month, sometimes lower than the interesticon estimated.
    I initially phoned them months agao requesting a copy of my agreement, phoned back a few weeks after - they had a record of my request - but I have still not received the agreement. Assume they have not got it.
    shall I write again, using the pro forma letter on the page re loans? give them a short deadline of 12 days?
    I have had an offer of one such company charging me 500£ and guaranteeing they can write it off. They seem ok - apart from charging upfront. I would prefer to try and tackle the matter myself - anybody got relevant experience?

    btw - this was initially a card sponsoring my then trade union - they have now concellled the contract with BoS.

    You need to request the copy of the agreement in writing.

    Is the account still with BOSicon or is it now with a debt collectionicon agency?

    Regarding writing the debt off, you can deal with this yourself with the help of CAGicon and save yourself 500 quid.

    thanks for your reply - the card is with BOSicon - for a limited period they had very ineffective call center agents from Halifix working for them i.e. hassling me by phone callicon - the annoying thing was that they never ever had the information about what I negotiated with the bank when for a limited time had to make reduced payments. When I went back to full payments I learned that BoS had 'closed' the card - although my statement every month still lists the originally higher credit limit. It is all a shambles - no professional behaviour in sight.

    can you kindly direct me to the pro forma letter to write to them to request the agreement - I still find the site a bit of a jungle

    Use template N here. Send it via recorded delivery with a one pound postal order. do not signicon the letter.

    Hi Rory,

    I am interested to see where this goes to from this point, I am in same position as Blockbuster but with M&S.
    I have sent letter N and followed it up with Account in Dispute letter.
    M&S have not suppilied CCA even though I sent CPR31.16 letter (Not sure if that applies in Scotland?) and case has been escalated to fosicon for their mediation.
    I really want to take them to court next and reclaim interesticon charges, PPIicon and any default payments, but would prefer a solicitor to advance the case.
    Any advice?
    Small Claims Court could not deal with this due to amounts involved.

    No it doesn't apply in Scotland. The Civil Procedureicon Rules only apply to England and Wales.
