    Default Capital One offer settlemenmt - edit - offer doubled, all repaid case won

    Basic history

    Capital Oneicon card, held for about 7 years, asked for refund PPIicon, got brush off from Ellie Renshaw, "sold properly, cooling off period blah blah"

    Sent second letter stating not accepting this, threaten Ombudsmanicon, point out they have produced no transcript of the phone conversation where it was sold, I had no recollection of ever asking for PPI and certainly didnt sign for it.

    Got a letter offering £850 as a gesture of goodwill in Full and finalicon settlement - according to them this is 50% of PPI plus 8% interesticon

    Do I accept or fight on?

    Never done this before, thanks for any advice

    its your money, they obviously know they are wrong, hence the offer.
    you could accept it as a partial settlement, but that opens other problems up.

    i'd write back refusing the offer, & stating that if i owed cap1 £1700 would they accept £850....i bet not!

    But I strongly vote fight on. The maxim "never accept their 1st offer" is generally good advice.

    Have they, in any way, addressed the point you raised about them having a recording of the telephone conversation? and when was the alleged call made? - (They probably haven't told you this, but you should know from your statements and or S.A.R. at least when they started deducting PPIicon premiums from your account).

    The reason I ask is because it will give myself and other caggers and idea as to how long they retain recordings of telephone callsicon; and this in turn provides us with ammunition... because establishing that they have no recording, establishes that, at the very least, they are going to have evidential problems proving the substance of the call.

    In their initial get lost letter they claimed the call was back in 2001 when the card was initially issued. I havent asked for a SARicon yet, but will certainly ask them how they have calculated their "50% plus interesticon" figure.

    I have had another look at this - the 50% plus 8% offer involves getting back half the charges and a simple 8% on top - never mind that the 8% is meant to be compunded isnt it, and they will have been charging me interesticon somewhere above 20% on this, so their "interest" on something thats been getting charged for 8 years or whatever amounts to what they would charge me in about 4 months

    Got another offer on this which I have accepted, basically they have refunded all the PPIicon so getting back approx £1700.

    Now I will turn attention to their charges, havent contacted them about them yet
