    • Thank you for that "read me", It's a lot to digest, lots of legal procedure. There was one thing that I was going to mention to you,  but in one of the conversations in that thread it was mentioned that there may be spies on the Forum,  this is something that I've read quite some time ago in a previous thread. What I had in mind was to wait for the thirty days after their reply to my CCA request and then send the unenforceable letter. I was hoping that an absence of signature could be the Silver Bullet but it seems that there are lot of layers to peel on this Onion.  
    • love the extra £1000 charge for confidentialy there BF   Also OP even if they don't offer OOC it doesn't mean your claim isn't good. I had 3 against EVRi that were heard over the last 3 weeks. They sent me emails asking me to discontinue as I wouldn't win. Went infront of a judge and won all 3.    Just remember the law is on your side. The judges will be aware of this.   Where you can its important to try to point out at the hearing the specific part of the contract they breached. I found this was very helpful and the Judge made reference to it when they gave their judgements and it seemed this was pretty important as once you have identified a specific breach the matter turns straight to liability. From there its a case of pointing out the unlawfullness of their insurance and then that should be it.
    • I know dx and thanks again for yours and others help. I was 99.999% certain last payment was over six years ago if not longer.  👍
    • Paragraph 23 – "standard industry practice" – put this in bold type. They are stupid to rely on this and we might as well carry on emphasising how stupid they are. I wonder why they could even have begun to think some kind of compelling argument – "the other boys do it so I do it as well…" Same with paragraph 26   Paragraph 45 – The Defendants have so far been unable to produce any judgements at any level which disagree with the three judgements…  …court, but I would respectfully request…   Just the few amendments above – and I think it's fine. I think you should stick to the format that you are using. This has been used lots of times and has even been applauded by judges for being meticulous and clear. You aren't a professional. Nobody is expecting professional standards and although it's important that you understand exactly what you are doing – you don't really want to come over to the judge that you have done this kind of thing before. As a litigant in person you get a certain licence/leeway from judges and that is helpful to you – especially if you are facing a professional advocate. The way this is laid out is far clearer than the mess that you will get from EVRi. Quite frankly they undermine their own credibility by trying to say that they should win simply because it is "standard industry practice". It wouldn't at all surprise me if EVRi make you a last moment offer of the entire value of your claim partly to avoid judgement and also partly to avoid the embarrassment of having this kind of rubbish exposed in court. If they do happen to do that, then you should make sure that they pay everything. If they suddenly make you an out-of-court offer and this means that they are worried that they are going to lose and so you must make sure that you get every penny – interest, costs – everything you claimed. Finally, if they do make you an out-of-court offer they will try to sign you up to a confidentiality agreement. The answer to that is absolutely – No. It's not part of the claim and if they want to settle then they settle the claim as it stands and don't try add anything on. If they want confidentiality then that will cost an extra £1000. If they don't like it then they can go do the other thing. Once you have made the amendments suggested above – it should be the final version. court,. I don't think we are going to make any more changes. Your next job good to make sure that you are completely familiar with it all. That you understand the arguments. Have you made a court familiarisation visit?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi im new on this site but i have always been a reader of it! it is excellent in giving advice and helping vunerable people stand up for themselves.

 

well I just thought id ask about perfect home another company like brighthouse! I am only asking about these as i have done alot of research ( just out of interest ) on brighthouse and how they treat people but not much comes up about perfect home considering they are vultures just like bright house!

Its called Perfect home.

 

If there is anybody out there who have had dealings with these then i would like to see some posts from you!

 

they are looking to open another 75 stores so if there isnt one near you look out!!!

Sorry to pick hairs here, but last time I put a companies web site on here, trying to spill the beans, I was CAGBotted for displaying a link to a company as it was deemed to be an advert!!!

 

That company was BAYV. So why is Perfecthomes so different? Even though this is a recruitment ad. Perhaps they need to circulate it to all BH employees!!!

Certainly I dont think it was me who Cagbotted you.

The poster appears to be suggesting that Perfect home is like for like the same as BH.

Without checking there can be no way to compare and so it would not be right to make any comparisons in absence of that.

I will remove the live link.

Feel free to talk of BAYV -if there is any obvious connection then I cant see any problems.

Its a continuous learning curve,and whilst links are generally moderated if they are advertising,if on the other hand they bear some input and importance to the discussion in hand then there can be discretion naturally.

PH are a looming threat, and whatever happens to BH, someone will be waiting in the wings to take their place. Prospective and existing customers of ANY predatory lender are welcome on here, as is anyone who wants to be part of the movement to stop this business type.

i just linked that part of the site as it showed the stores that were soon to open!

 

well there has been one open in liverpool now for just over a year!

 

well some of my friends are with both these places and I must say they dont give up! I am a reference for a couple of them!

 

lucky I am quite clued up on these so I can help my friends!

Well thanks for your input and you are right, these guys definately fit into the vultures category (well the NOTW wanted me to quote "vultures" and I quite like it now!!)

 

Unfortunately, we regularly get visitors from employees of these vulture type companies, stating they are here to help, when they only have hidden agendas. When we manage to score one against them, like the NOTW piece, it brings them out of the woodwork!!

 

Your input here would be welcome, as this battle is a long way from over. Tell your friends how to find us and together we can help make sure they are treated as customers should be, with respect!

Hi i can help with some input here as im about to start a dispute with them if possible.

 

My missus has bought a plasma tv off Perfect Home, which since getting it in Sept 08 has been replaced 5 times, but the thing got my goat up, besides that, is at christmas she bought me a Stereo from Perfect Home as well, and i found the agreement and its shocking.

 

The price of the Stereo is £263 which with £72 interest i was not bothered with that aspect and it worked out £3.24 for 104 weeks, but then i noticed a Fixed Sum Agreement for £2.38 for 104 weeks, and a TAD agreement for £1.14 for 104 weeks, total payable works out about £700.

 

My missus did not have a clue what she was signing for, but it seems the fixed sum agreement is for protection and is on a separate agreement, as for TAD, I haven't a clue.

 

So far all payments are up to date, so no probs there but, does anyone know if you can challenge this fixed sum agreement and TAD agreement.

 

Please dont shop there, i went mad at her indoors, rip off, total rip off.

I think that's right!

Hey everyone!

The fix sum loan agreement is your coverplus extended warranty and the TAD is the theft, loss or accidental damage cover. If you have home contents insurance, take the policy docs into the store and they'll take the TAD off both of your agreements. If you talk to the manager about taking the coverplus off, it's up to them I'd they do it or not.

 

With regards to your television, with your coverplus you have the right to return it. If you do so and get another tv from the same store, any money you've paid off your existing tv will get moved across against the new agreement, so you don't lose any money. they have a new range of panasonic freesat plasmas which are lovely.

 

How do I know all of this? I work for perfect home. Have been for almost a year. Didn't really know what they did before I started, naive I guess. Anyway, a jobs a job at the moment. Not keen on what they do but hope I can help people on here out, have been an avid reader of the forum for yonks!

Yeah and old area manager's of Brighthouse its exactly the same company but longer terms with a little less APR you still pay back more

hi im new to this site,

ive recently had problems with brighthouse, i have been a customer for over 15 years and never had problems until recently. with changing to monthly salary i fell behing with my payments. i now pay for my items monthly except for my laptop which i pay weekly. with the climate the way it is at the moment i was 3 wks late paying for my laptop although i rang and sed i wudnt be able to pay until a certain date i still got letters phonecalls and visits. i then rang to pay yesterday and told them i wasnt going to paythe osc for the last 3 wks because i havnt been covered i was immediatly put on to a manager who sed i had to pay it. i refused and told them i was contacting there headoffice on monday. i paid the rest of my account which is upto date anyway but refused to pay for the laptop until i spoke to head office he wasnt happy as the payment shud of been £55. i then told him that if the osc was optional why 15years ago was i told that if i didnt take it out each time i cudnt have the items. he was quite nice about it actually and sed it is optional. i then told him i wanted to cancel it on all my items i worked it out and it comes to £46.00 per month. he then rang me back less than 5mins later and told me he would discount the last 3wks osc off my laptop. one nil to me a thinks. i was wandering if i have been with brighthouse for 15years the amount of items i have had from them would probably cover an a4 size paper could i claim all my osc back as i was told i had to have it? could anyone advise me of this

let me just clarify for you,

 

perfect home is definitely the same as bright house, the company is run by ex-managers of bright house and also the ceo is in charge of perfect home who was from bright house!!!

 

The company will treat you exactly the same as bright house so please be careful, its a dying breed now as people are more savvy, also keep the OFT debt guidelines close to your heart as this will be your bible.

 

Dont buy from them you will regret it, save your money, otherwise you will be paying for refurb TV's etc for years. I KNOW THIS BECAUSE I'M AN EX-EMPLOYEE.

Hey Adam me & My husband WAS a customer of Perfect homes,got a laptop on credit.... we rang & rang & rang & rang the store to see where it was & when it was comming!! anyways.. it finally came after ringing for 3 weeks, this wasnt the laptop we asked for,then the girl in the leeds branch was not very well trained in customer services skills,when i rang to say ''this isnt the laptop we asked for ... infact very rude and abrupt she was .. anyways as time went on.. 1 problem after another, and all we got was '' we are dealing with the problem & looking into the matter . but you must keep up your payments ( pay for something we didnt order)? i demanded they take it back and send the 1 we asked for ... 2 weeks later still no explanation on why we didnt get the 1 we ordered.. so we told them to come & take it back... it wasnt what we asked for and not paying for something we didnt think was good value!!!! anyways not 1 but 2 people came to collect this laptop.. haha in force !! anyways enough of me waffleing on just wanted to say ... Perfect homes??? think it could do with a re-vamp name NOT SO PERFECT homes & items :roll:

Im probably in the wrong place to post regarding Brighthouse if so i apologise in advance.

Most in fact the majority of these complaints also similiar to Perfect Home problems appear to derive from the initial point of sale and the customer not being fully advised by the copmpany sales staff as to the context of the agreement they are about to sign in PLAIN ENGLISH or their rights to refuse the "optional cover".

If the above are not fully explained is that not considered a breach of the Consumer Protection From Unfair Trading Regs 2008 with regard the Misleading Omissions6....Paragraph 2( c.)..The commercial practise provides material,information which is unclear,unintelligible,am bigious leading to (d) the commercial practise fails to identify its commercial intentand as a result it causes or is LIKELY TO CAUSE THE AVERAGE CUSTOMER TO TAKE A TRANSACTIONAL DECISION HE/SHEWOULD NOT OF TAKEN OTHERWISE !

I have researched deeply into both Perfect Home & Brighthouse and have collated enough information that i am confident exposing them for many legal reasons and many consumer credit contaventions.

I am unsure if you would find the info of use but am happy to give it all to you in order for you to find the correct path to prevent people being lured into such agreements without being made fully aware of their alternatives.

Using CPUT you can complain to Trading Standards about Unfair Commercial Practices.

Complaining under CPUT is easy to do. It costs no money and carries no risk.

However, you may also need to bring your own direct action to produce a solution to your own problem or to get compensation.

Perfecthome is in no way connected to Brighthouse, Perfecthome began as part of what was the Homebuy Group, who went into administration in September 2006. At this point they (homebuy) had only opened 2 stores under the name of Perfecthome, these are the Birkenhead and Ashton Stores. 3 people got together with the backing of a Venture Capitalist and put the money up to buy them, taking from Homebuy a good few members of staff. Perfecthome(temple Retail and Finance) now have over 30 stores, and sadly are no better than Brighthouse, in fact they are probably worse because they have never attempted to correct the many bad practices Brighthouse employ.

Somebody asked what TAD was, well it stands for Theft and Accidental Damage, but really just masks another way of getting money from you. Many store managers are told not to sell any product unless the customer takes out the TAD policy as well. You all must remember these companies are not giving you credit, you are actually buying on HP !! and the laws regarding this type of purchase are very very different to credit agreements.
