Hi All, I was about to start my claim for bank charges with the Clydesbank but I was wondering if it still only 5years back we can claim in scotland I know that the small claim has been raised to £3000 but I would like to go back to 2002 - I suppose nothing ventured nothing gained especially since I intend to claim under "financial hardship". Can anyone clarify this - many thanks
PS I was in the bank today to cancel some dd's. There was a lady in front of me complaining about a £35 charge for being 99p overdrawn for one day. The teller whittered on about the money being in place the day before etc. etc. but said she would speak to her manager - so off she went - when she came back she gave the lady a print out of the charges made to the account and told her to hold on to it in case she needed it once the court case was settled that her manager had said she may get her charges back then - now they are using this case as a way of avoiding any unpleasant meetings with their clients i.e.you and me - interest - well I thought so.
Hi Maroondevo52, Thanks for info, I would hate to miss out on a whole years charges. I was going to go for a hardship claim but recently got some info re the situation up hear in Inverness. Namely that a certain sheriff will not the banks get their stay. I know I might not get that particular sheriff but the advice was that the banks do not want this go court up here because of this and settle. Even if they don't they will have to pay for a very expensive barrister to come up from Edinburgh.
Anyway thats my plan now.
Vital spark v Lloyds Tsb 2nd November 2006: 1st letter, requesting back statements, hand delivered to lloyds TSB: got receipt.
I have received the information on my accounts going back 6 (six) years but not going back to the begining of my hsitory with the bank, as I requested.
Think I'd best send a letter suggesting they send the lot and informing them that I have already paid the £10 for such information.
Mairi's awaiting my details so that she can help me work out the interest due on the charges taken.

just sent off prelim. letter to the bank for our joint account so they have 14 days to respone. I am in the process of look at my husband business account is there any template letters for business account.
Thanks Maroondevo52 I will. Could you answer a quick question? As this is a joint account do I have to put both our names on small claims form. I am assuming that I only have fill in one claim for us both.
Sorry Maroondevo52 I have another question. The reply I received from CB come from Leeds do I send my LDA back to that address or do I continue to correspond with St.Vincent Place, Glasgow, and would that go for the small claims also.
I think either one of you can sign, I sent all my stuff, including my Court papers to my Local Branch, all seems to end up in the same place, I'd send it to Glasgow.
